LAWS OF MARYLAND,

CHAP. 164.

fore described, all the powers, rights and privileges, lawful
ly exercised by, and all property, estate, and effects, vested
in the former commissioners of Cecil county, shall be trans-
ferred to and vested in the commissioners for Cecil county,
elected by virtue of this act, who, or any three of them,
shall thereafter exercise all the said powers, rights and pri-
vileges, and shall perform all the duties required to be per-
formed by the said former commissioners of said county,
after they shall have become qualified as aforesaid.

Clerk.

Sec. 5. And be it enacted, That the commissioners for Ce-
cil county shall, at their annual meetings, appoint a well
qualified, fit and proper person, a resident of said county, to
act and serve as clerk to the said commissioners, who shall
transact all the business, and discharge all the duties by law
authorised and required to be transacted by the clerk of the
former commissioners; and the person so appointed shall,

Bond.

before he enters upon the duties of his office, execute a bond
to the State of Maryland, to be approved by the said com-
missioners, in the penalty of one thousand dollars, condi-
tioned for the true and faithful performance of the several
and respective duties hereby imposed, which bond shall be
recorded in the clerks office, of the county court of said
county, and a copy thereof, under the seal of said court,
shall be as sufficient evidence as the original; and the said
clerk, when appointed, shall also take and subscribe the
following oath or affirmation, (as the case may be) to wit:

Oath.

"I, A. B. do swear or affirm, that, as clerk to the, commis-
sioners of Cecil county, I will honestly and faithfully, to the
best of my skill and judgment, execute the duties of said of-
fice, without favour, affection, or partiality, so help me God;"
which oath or affirmation any one of the said commissioners
is hereby authorised to administer; and the said clerk shall
be subject to the same penalties and forfeitures, for non-
performance or neglect of official duty, as are prescribed
by the existing laws of this State, in relation to the clerk of
the former commissioners.

Vacancy of clerk-

Sec. 6. And be it enacted, That in case of a vacancy
occurring in the office of clerk to the commissioners as-
created by this act, in consequence of death, resignation,
removal or disqualification, the same shall be supplied as
soon thereafter as may be practicable, in the manner pre-
scribed and directed by the preceding section of this act.

Clerks compensa-

Sec. 7, And be it enacted, That the said clerk of the
commissioners, to be appointed in virtue of this act as
aforesaid, shall be entitled to receive as compensation for
his serrices, such sum annually as the said commissioners
may direct, not exceeding the sum of three hundred dollars
