LAWS OF MARYLAND.

CHAP 107.

servant or slave guilty of a breach of any ordinance, unless
the master or mistress pay the fine annexed to the offence;
to lay and collect taxes for all purposes necessary for car-
rying into effect the ordinances and by-laws of the town;

Proviso.

Provided, That the said taxes shall not exceed twenty cents
on every hundred dollars of taxable property in any one
year; to preserve the peace and good order of the town,
to make a new assessment of all the real and personal pro-
perty of said town, as often as it may seem necessary; and
to pass all ordinances to give effect and operation to all the
powers vested in the corporation of the town of Emmitts-
burg.

Constables and
other officers.

Sec. 2. And be it enacted, That one constable may be ap-
pointed for the said town of Emmittsburg, in such manner
as may be directed by ordinance of said corporation, who
shall have all the power and authority of constable within
the limits of the corporation except in the cases of small
debts; and that any other officer or officers of the corpora-
tion not herein named or not named in the original law, to
which this is a supplement, shall be appointed in such man-
ner as shall by ordinance be directed; and that the person
appointed to collect any tax imposed by virtue of the pow-
ers granted by this act, or the act to which this is a sup-
plement, shall have full power and authority to collect the
same by distress and sale of the goods and chattels of the
person chargeable therewith, but it shall be the duty of
such collector to give at least ten days public notice in writ-
iug, in a number of the most public places in said town, of
the time and place of said sale.

Competent witnes-

ses.

Sec. 3. And be it enacted, That the inhabitants of the
said town, and all persons holding property therein, shall
be competent witnesses in all actions under this act and the
act to which this is a supplement, or the by-laws and ordi-
nances of said corporation, if exempt from all other ex-
ceptions, than that of interest as an inhabitant of the said
town, or member of the said corporation.

Vacancy of Bur-
gess.

Sec. 4 And be it enacted, That in case of the death, re-
fusal, disqualification, resignation, or removal of the burgess,
out of the limits of the corporation, the commissioners for
the time being, shall act as burgess for the remainder of
the time for which he was to serve or was elected.

Authority of Bur-
gess.

Sec. 5. And be it enacted, That the burgess of the town of
Emmittsburgh, shall in virtue of his office, have and exer-
cise, within the limits of the corporation, all the jurisdiction
and power of a justice of the peace, except as to the re-
covery of small debts; and shall see that all the ordi-
nances and by-laws are duly and faithfully executed, and he
