CHAP. 9.

LAWS OF MARYLAND
ways, that if the owner or owners of the said geese or
swine can prove to the satisfaction of any one of the jus-
tices of the peace residing in said town, that the said geese
or swine did not go at large from negligence or want of
care on the part of the said owner or owners, and that due
diligence was used to prevent it, then and in that case the
owner or owners shall have return of the said property, on

paying all expenses of keeping and proving the same.
Sec. 2. And be it enacted, That all acts repugnant or
inconsistent with the provisions of this act, be and the
same are hereby repealed.

CHAPTER 8.
An Act to authorise the Clerk of Allegany County to
Record the Deed therein mentioned.

Be it enacted by the General Assembly of Maryland,
That the clerk of Allegany county be, and he is hereby
authorised and required, to record a deed from Benjamin
Whitehead to Jonathan Frazier, dated the third day of
March, in the year of our Lord one thousand flight hundred
and nineteen, for a tract of land called Friend's Choice,
situate, lying and being, in Allegany county, containing
one hundred and six acres; and that the same, when re-
corded, shall be as good and sufficient in law to convey
the fee-simple estate therein mentioned, as if the same had
been recorded within six months from the date thereof, and
as if the names of grantor and grantee in the said deed

Proviso

were properly transposed in said deed; Provided, that
nothing in this act shall be construed to affect the interest
required by any third party to the property therein men-
tioned, legally acquired since the date of said deed.
