town, whose duty it shall be, under oath, to value and as-
sess the assessable property of Middle-Town, and the seve-
ral additions thereto, and to return the same to said court,
who rnav allow him such reasonable, compensation as in
their judgments shall seem right for his services aforesaid,
the same to be included with the other damages and costs
arising under the act to which this is a supplement.

An Act to incorporate the Frederick and Emmitsburg
Turnpike Road Company.

Section 1. Be it enacted by the General .Assembly of
Maryland, That a company be incorporated to make a
turnpike road from the city of Frederick, in Frederick
county, to Mechanic,s-town, and thence to the town of Em-
mitsburg in said county , and from thence to intersect the
Pennsylvania line at the nearest point on the route to Get-
tysburg, Adams county, Pennsylvania.

Sec. 2. And be it enacted, That subscription books shall
be opened in the city of Frederick, Mechanics-town, and
Emmitsburg, and the same shall he opened at Frederick-
town under the direction of Doctor William Tyler, Rich-
ard Potts, John M'Pherson, Caspar Mantz, George Balt-
zell, and William R Sanderson; at Mechanics town, under
the direction of Jacob Weller, (blacksmith) Henry Fun-
denburgh. Jacob Firor, and Robert C. Brien; and at Em-
mitsburg under the direction of Lewis Motter, Isaac Baugher,
George Grover, and John Stewart; for a capital stock of
eighty thousand dollars, in shares of twenty dollars each,
who are hereby appointed commissioners for the purpose
aforesaid, who after at least twenty days notice by pub-
lication in the several newspapers of Frederick city, of
the time and place of opening said subscription books, at
which time and at each place at least three of the above
named commissioners shall attend, and shall permit all per-
sons and corporations, who shall offer, to subscribe in per-
son, or by attorney, for stock in said books, which shall be
Kept open for that purpose at least four hours in each day,
for three successive days, if necessary, and if the whole of
the said capital stock be not then subscribed for, the said
commissioners may re-open said books at such time and
Place as they may think fit, under the direction of the said
commissioners, or any three of them, for further subscrip-
