further, that the costs of the record in case of appeal,

 

shall be paid or tendered to the treasurer of said

 

county, or to the clerk of the county commissioners,

 

within thirty days from the date of said appeal, and

 

in case the costs of said appeal are not paid or

 

tendered as aforesaid, within the period aforesaid,

 

it shall be lawful for said county commissioners to

 

proceed to act in the premises as if no such appeal

 

had been taken, and in case any appeal is taken as

trial, and in cases of a trial before the court at any

 

time before judgment is entered.

 

SEC. 3. And be it enacted, That when no objection
