CHAPTER 423.

AN ACT to repeal section twenty, article twenty-
|
 
|
eight, of the Code of Public General Laws, title
|
 
|
" county commissioners," sub-title " roads," and
|
 
|
to re-enact the same with amendments.
|
 
|
SECTION 1. Be it enacted by the General Assembly of
|
 
|
Maryland, That section twenty, article twenty-eight,
|
Repealed and
re-enacted.
|
of the Code of Public Genral Laws, title "county
commissioners," sub-title "roads," be and the same
|
 
|
is hereby repealed and re-enacted so as to read as
|
 
|
follows :
|
 
|
20. No public road shall be opened or altered so
|
Shall not be
opened.
|
as to pass through the buildings, gardens, yards, or
burial grounds of any person without the consent of
|
 
|
the owner thereof.
|

SEC. 2. And be it enacted, That this act shall take
|
 
|
effect from the date of its passage.

CHAPTER 424.
|

AN ACT to incorporate the Cumberland and Ohio
|
 
|
Canal Company.
|
 
|
WHEREAS, The United States, the States of Vir-
|
 
|
ginia, Maryland and Pennsylvania, chartered a com-
pany to construct a navigable canal from the tide-
|
 
|
water of the Potomac River, in the District of Col-
|

umbia, to the City of Cumberland in the State of
|
 
|
Maryland, and extending thence across the Allegany
|
 
|
Mountains to some convenient point on the navigable
|
 
|
waters of the Ohio River, or some of its tributary
|
 
|
streams, and
|
 
|
WHEREAS, The eastern section of the Chesapeake
|
