umbia, to the City of Cumberland in the State of

 

Maryland, and

 

WHEREAS, The time fixed in said charter for the

 

completion of that portion of the canal from Cum-

berland to some point on the Ohio River has expired,

WHEREAS, The agricultural, mechanical, mining

 

and manufacturing interests now, more than ever

 

heretofore, demand that this national highway shall

be completed at an early day, and

 

WHEREAS, The Chesapeake and Ohio Canal Com-

 

pany heretofore chartered, has been so embarassed

 

that it has been unable to complete the said canal, it

 

is therefore the meaning and intention of this act, to

 

charter another company, to construct, operate and

maintain a canal from the City of Cumberland, in

 

the State of Maryland, to some convenient point on

 

the Ohio River, and to grant to the said company

 

hereby incorporated, similar rights, powers, exemp-

 

tions, privileges and franchises in the construction

 

and maintenance of this work, as are now held and

 

enjoyed by the Chesapeake and Ohio Canal Com-

 

pany, under its charter and several supplements

 

thereto; therefore —

 

SECTION 1. Be it enacted by the General Assembly of

 

Maryland, That A. P. German, J. G. Berrett, M.

 

Bannon, D. S. Biser, G. M. Watkins, P. Hamil, Gil-

 

mor Meredith, Alex. Shan, W. W. McKaig, John

 

Ritchie, Lloyd Lowndes, Henry G. Davis, Thomas

Incoporated

Moore, E. C. Pechim, James S. Negley, G. H. Thur-

 

ston, J. K. Moorhead, Frank Cowan, and such other

 

persons as may become associated with them, in the

 

manner hereinafter provided, shall be and they are

 

hereby constituted a body corporate and politic by the

 

name of the Cumberland and Ohio Canal Company,

 

and as such shall have all the rights, powers, exemp-

its charter, passed by the Legislature of the State of

 

Virginia, at the December session, eighteen hundred
