the direction of the justice of the peace adjudging
such forfeiture ; one-half of all tines so imposed, and

 

forfeitures so adjudged, to go to the informer, and

 

the other half to the school fund of said county; and

 

all costs of such prosecution to be paid by the party

 

convicted.

 

SEC. 4. And be it enacted, That the possession of

 

any live partridge shall be prima facie evidence that

SEC. 5. And be it enacted, That every justice of the

himself aggrieved by the judgment of any justice of
the peace, in any trial for the violation of this act,

 

may appeal to the Circuit Court for said county;

 

provided, he shall give notice of such appeal within

shall, within ten days after the rendition of said

 

judgment, deliver to the said justice an appeal bond,

 

executed to the State of Maryland, in the penalty of

 

fifty dollars, conditioned for the successful prosecu-

 

tion of said appeal.

SEC. 7. And be it enacted, That all prosecutions

 

under this act shall be docketed in the name of the

 

State of Maryland as plaintiff.

 

SEC. 8. And be it enacted, That this act shall take
