and upon conviction thereof before a justice of the

 

peace, or upon indictment and conviction in the

 

Circuit Court for Worcester county, shall be fined

 

not less than ten dollars nor more than one hundred

 

dollars, and pay all costs; one-half of said fine to be

 

paid to the informer; and in all cases of conviction

 

of the party arrested, or sale of a gun, net, fire-light

 

or boat, under this act, the officer making the arrest

 

or seizure, shall be entitled to a fee of ten dollars, to

 

be collected from the party convicted, or from the

 

proceeds of sale of said gun, net, fire-light or boat,

 

in addition to all other costs.

 

SEC. 4. And be it enacted, That when any person

 

is convicted of the violation of any of the provisions

of this act, and refuses, neglects or fails to pay the

 

fine for which judgment is given against him, and all

 

costs, he shall be committed to the county jail of

 

Worcester county, for a period of time not less than

 

ten days, nor more than forty days; but the party or

 

parties so committed to be released on the payment

 

of the fine, costs and jail expenses.

 

SEC. 5. And be it enacted, That upon information

 

given upon oath to any justice of the peace of Wor-

 

cester county, of any violations of any of the pro-

offenders, and the seizure of the gun, net, fire-light

 

or boat, together with the tackle or furniture on

 

board, which warrant shall be directed to the sheriff,

 

or any constable of Worcester county, commanding

 

the said sheriff or constable to bring the offender or

 

offenders before some justice of the peace of Wor-

 

cester county.

 

SEC. 7. And be it enacted, That when the sheriff or

 

any constable of Worcester county, shall arrest any

 

person or persons for a violation of any of the pro-

and take into custody any gun, net, fire-light or boat

 

used by such person or persons, in violating any of

 

the provisions of this act, on conviction of the per-

 

son or persons so arrested, the gun, net, fire-light or

of the provisions of this act, shall be condemned, and

 

such condemnation shall be a part of the judgment
