SEC. 2. And be it enacted, That said fees, or. any

portion thereof, may be placed in the hands of said

sheriffs at any time prior to the first day of March,

eighteen hundred and seventy-five, and said sheriff
|
 
|
shall account for and pay over the same within nine
|

months from the time when such fees may have

been placed in their hands for collection, and on
|
 
|
failure to collect and pay over the same within the
|
 
|
time prescribed by this act, to the said John A.
|
 
|
Camalier, he shall have the same means of recovery
|
 
|
against the official bonds of such sheriff's as now pro-
|
 
|
vided by law.
|
 
|
SEC. 3. And be it enacted, That nothing in this act
|
 
|
contained shall be construed to make any sheriff
|
 
|
answerable for the failure to collect any fees placed
|

in his hands as aforesaid, unless the same, by the use

of due diligence, could have been collected; and,
|
 
|
provided, that this act shall not be construed so as to
|
 
|
deprive any of the parties against whom such fees
|
 
|
shall be demanded from any defence to which they

are now entitled by law.

SEC. 4. And be it enacted, That this act shall take
