CHAPTER 77.
|
 
|
AN ACT to repeal section one, of an act passed at
|
 
|
the January session, eighteen hundred and seventy-
|
 
|
two, chapter one hundred and thirty-one, entitled
|
 
|
an act for the better protection of, oysters, clams,
|
 
|
terrapins and fish in Synepuxent Bay and its tribu-
|
 
|
taries, in Worcester county, and to re-enact the
|
 
|
same with amendments.
|
 
|
SECTION 1. Be it enacted by the General Assembly of
|
 
|
Maryland, That section one of an act passed at the
|
 
|
January session, eighteen hundred and seventy-two,
|
 
|
chapter one hundred and thirty-one, entitled " an
|
 
|
act for the better protection of oysters, clams, terra-
|

pins and fish in Synepuxent Bay and its tributaries,

in Worcester county," be and the same is hereby
|
 
|
repealed and re-enacted so as to read as follows:
|
 
|
SECTION 1. A. Be it enacted by the General Assembly of
|
 
|
Maryland, That it shall be lawful for any citizen of
|
 
|
the State of Maryland, to take out a license from the
|
 
|
Clerk of the Circuit Court of Worcester county,
|

aforesaid, which shall have effect from the first day
|
 
|
of May, in the year in which the said license is issued
|
 
|
to the first day of May, in the year next succeeding;
|
 
|
for which said license the applicant shall pay the sum
|
 
|
of three dollars, and the said clerk shall pay over
|
Fee lor.
|
said money to the County Commissioners of said
|
 
|
county, to be expended by the said County Com-
|
 
|
missioners of said county, in the purchase of seed
|
 
|
oysters to be planted in said Synepuxent Bay; and
|
 
|
upon taking out such license, and not otherwise, it
|
 
|
shall be lawful for the said citizens so obtaining the
|
 
|
same, to take or remove oysters from the natural
|
 
|
rocks in the waters of said Synepuxent Bay or in any
of its tributaries, included in the boundaries of said
|
 
|
Worcester county, with rakes or tongs; provided, that
|

this act shall not authorize the taking or catching of
|
 
|
oysters with rakes or tongs or any other instrument,
|
 
|
between the first day of May and the first day of
|
 
|
October in each year, which is hereby expressly
|
 
|
forbidden ; and provided that nothing herein shall be
|
 
|
so construed as to prevent any person from catching
|
 
|
