Maryland, and to authorize, to exercise the powers

 

and privileges of a corporation within the State of

 

Maryland, for mining and other purposes, " be and

 

the same is hereby repealed, and the following

SEC. 2. And be it enacted, That for the purpose of

 

enabling said company to carry on its said business,

mines and works, the said company is hereby invested

 

with all and singular, the rights, powers and privileges
authorities, immunities and advantages of surveying,

 

locating, establishing and constructing a railroad

some convenient point on or near the Cumberland

 

and Pennsylvania Railroad, or the Baltimore and

 

Ohio Railroad, and for using, controlling, preserving

 

and maintaining the said railroad, its necessary ap-

 

purtenances, vehicles and equipments, which by the

 

act of the General Assembly of Maryland, and more

particularly the fifteenth section thereof, incorporating

 

the Baltimore and Ohio Railroad Company and its

 

several supplements were, for the lawful purposes of

 

said company and the benefits of its corporation,

 

given, granted, authorized and secured to said com-

 

pany as fully and perfectly as if the same were herein

 

repeated ; provided, that any corporation, person or

persons, shall have the privilege of connecting a lateral
road with the main railroad of said company, and to

 

transport thereon, its, his or their coal, merchandise or

 

other property, subject to the reasonable regulations of

 

said company, and under its exclusive management

 

and control ; and the payment of such tolls as it may

 

impose, not exceeding six cents per ton, for each

 

mile or fraction of a mile, over or under an integral

 

number of miles, and not exceeding five cents per

 

mile for each passenger transported thereon.

 

SEC. 3. And be it further enacted, That this act shall

 

take effect, and be in force from and after the date
