except spirituous and fermented liquors, during the season
for fishing for shad and herring, by applying to the Clerk of
the Circuit Court for the county where such fishery is situ-
ated, and paying to the Clerk six dollars therefor, and the
usual fee for issuing the same.

SPIRITUOUS OR FERMENTED LIQUORS BY RETAILERS.

SEC. 58. When any person or corporation intends to sell or
barter spirituous or fermented liquors in quantities not less
than a pint, he or it shall apply to the Clerk of the Circuit
Court, and shall present his recommendation as hereinbefore
required, or shall apply to the Clerk of the Court of Common
Pleas, as the case may be, as hereinbefore provided, and the
Clerk of the Circuit Court shall grant no such license with-
out such recommendation,

SEC. 59. Upon such application, the applicant shall state
on oath to he administered by the Clerk, the amount of his
stock of spirituous or fermented liquors or lager beer gener-
ally kept on hand by him, or the concern in which he is en-
gaged, at the principal season of sale, or if paid applicant shall
not have been previously engaged in such trade or business,
he shall make oath to the amount of such stock he expects to
keep as aforesaid.

SEC. 60. If it shall appear to the Clerk of the Circuit Court,
or the Clerk of the Court of Common Pleas, as the case may
he, that the amount of the applicant's stock in trade does not
or will not exceed one thousand dollars, the sum of fifty dol-
lars shall be demanded and received by the said Clerk from
said applicant before granting the license applied for.

61. If more than one thousand dollars and not more than
two thousand dollars, the sum of seventy-five dollars.

62. If more than two thousand dollars and not more than
three thousand dollars, the sum of one hundred dollars.

63. If more than three thousand dollars and not more than
four thousand dollars, the sum of one hundred and twenty-five

dollars.

64. If more than four thousand dollars and not more than
five thousand dollars, the sum of one hundred and fifty dol-
lars.

65. If more than five thousand dollars and not more than
ten thousand dollars, the sum of one hundred and seventy-five
dollars.

66. If more than ten thousand dollars and not more than
twenty thousand dollars, the sum of two hundred dollars.
