ing a new court house, with suitable apartments for the
court, bar and juries, clerks and registers, as directed in
the second section of this act; which said assessment so
as aforesaid to be made and levied, shall be collected by
the collector of the county taxes for the time being, in the

and the said money or any instalment thereof, when col-

lected, shall be paid over by such collector to the aforesaid
Commissioners, or the majority of them, appointed by this
act, to contract for building said court house, and which
said commissioners, or a majority of them, are hereby au-
thorised and required to receive and apply the same to the
use add purposes by this act directed.

Sec. 4. And be it enacted, That the said commissioners,
or a majority of them, shall be, and they or a majority of
them are hereby authorised and required to contract and
agree for the building said court house, and the apartments

foresaid, and to direct the plans of the game, which said
court house and apartments when erected, finished and
completed, shall be used, taken, held and deemed to be
the proper court house and apartments of Allegany county
for the purposes aforesaid.

Use

Sec, 5. And be it enacted, That the commissioners
hereby appointed to contract for said building, or a ma-
of them, shall and are hereby authorised to shut up
connect with the public ground aforesaid, that part of
Johnson street running from Washington street south, as
far down as the depth of said public ground, if in their dis-
cretion it should be deemed necessary in building said
court house and apartments, and when shut up, the said
part of said street shall be thrown in and connected with
the public ground for the better finish and ornament of
the public square to be used for building said court house,
with the public ground aforesaid.

Sec. 6. And be it enacted, That in case any of the said
commissioners shall die, remove, refuse or discontinue to
act, the remaining commissioners, or a majority of them,
shall appoint some person or persons as the case may be,
to fill up the vacancy; and the said commissioners, or a

majority of them, shall annually render a full and fair ac-
count to the commissioners of Allegany county, of the re-
ceipts and expenditures of all monies which shall by them
be received and expended in virtue of this act.
