county, be and they are hereby appointed commissioners
to examine the ground and route for a turnpike road from
Cumberland, in the state of Maryland, along the valley of
Evit's creek, to the Pennsylvania line, to join a turnpike
road from Hollydysburg, on the Pennsylvania canal, through
the said valley of Evit's creek, and report their proceed-
ings to the next Legislature of this state.

CHAPTER 72.

 

An act to authorise the location and establishment of Falls
Avenue in Baltimore.

Passed Feb. 7, 1834

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the city commissioners of the city of Bal-
timore be and they are hereby empowered to locate and
establish Falls Avenue, with a width of twenty feet from
the north line of Eager street, along the western side of
the water company's canal, to the line of Salisbury Plains,
where it crosses the said canal; taking care to leave space
between the said avenue and the edge of the canal for the
erection of a fence or other suitable protection to passen-
gers against falling into the canal; and also to condemn
the said street from Eager street to the line of Salisbury
Plains as a public street or way, and so to record the same

Authority to locate

among their records of the establishment of streets, lanes
and alleys of the city of Baltimore: Provided, however,
that the provisions of this act shall be of no force or effect
unless approved by the Mayor and City Council of Balti-
more.

Proviso

Sec. 2. And be it enacted, That before the Mayor and
City Council of Baltimore shall pass any ordinance or reso-
lution approving the provisions of this act, they shall first
give public notice of the application which may be made
for the purpose, by advertisements inserted for one week
in all the daily newspapers of the city of Baltimore, the
expenses of which advertisements shall be paid by the
party or parties making the said application.
