CHAP. 54.

ick, of the time and place, for an additional capital stock
of six thousand dollars, in shares of twenty dollars each,
upon the terms of the said act to which this is a supple,
ment.

May proceed if 150
shares are taken

Sec. 3. And be it enacted, That when one hundred and
fifty shares shall have been subscribed, the said Turnpike
company may proceed to make and construct the Turn-
pike road, in the first section of this act specified and au-
thorised.

How constructed

Sec. 4 And be if enacted, That the said Turnpike road
shall be made in the manner and style prescribed by the
tenth section of the act, entitled, an act to incorporate the
Frederick and Woodsborough Turnpike company, passed
January thirtieth, eighteen hundred and thirty-two.

Examination

Sec. 5. And be it enacted, That as soon as the said Turn-
pike road shall have been completed, in the manner and of
the length aforesaid, the said company shall and may ap-
ply to the Governor of this state, to have the said road
examined and approved, in the manner, prescribed by the
eleventh section of the act, entitled, an act to incorporate
the Frederick and Woodsborough Turnpike company, pas-
sed January thirtieth, eighteen hundred and thirty-two, and
when so approved, the Governor shall, by licence, under

his hand, authorise the said company to erect gates upon
and acroes the said road, and to take tolls for the use,of the
said company, in proportion to its length, in the same and
as ample manner as the said company may do, on and for
the use of the Turnpike road now made and yet to be
made, in pursuance of the act to which this is a supple-
ment.

Three years allow-
ed

Sec. 6. And be it enacted, That the said company may
or may not avail themselves of the power, authority, rights
and privileges conferred upon them by this act, as to them
may seem meet, at any time within three years from the
passage of this act.

Limitation

Sec. 7. And be it enacted, That if the said company shall
not avail themselves of the power, authority, rights and
privileges conferred upon them by this act,within the space
of three years from the passage of this act, and within
said time proceed to construct the Turnpike road, contem-
plated and authorised to be constructed by this act, then
this law to be void.

Rights of subscrib-
ers, &c.

Sec. 8. And be it enacted, That the subscribers for stock
in pursuance of this act shall be, and hereby are declared
to be members of the said Turnpike company, and entitled
