CHAP. 209

eleven years, to the aforesaid Bernard Gilpin, and dated
the twenty first day pf December, eighteen hundred and
twenty-six; and the said indentures when recorded, shall
have the same force and effect as if the same had been re-
corded within the time prescribed by law, any law to the
cohtrary notwithstanding.

CHAPTER 209.

Passed Mar. 12,1834

An act to lay out and open a new Road, in Anne Arundel
and Montgomery counties.

Commissioners to
open, &c.

Section 1. Se it enacted by the General Assembly of Ma-
ryland, That Dr. Charles Ridgely, and Samuel Carr, of
Anne Arundel county, and Roger Brooke, Thomas Stabler
and Isaac Holland of Montgomery county, be, and the same
are hereby appointed commissioners to lay out, make pub-
lic, and open a road, commencing at the road leading from
Sandy spring, to Washington city, near Dr. William Pal-
mers in Montgomery county, and running from thence by
Brown's Ford, on the Patuxent, in the direction of Owing's
Mills, in the most direct practicable route to intersect the
road leading from Snell's bridge to said Mills in Anne
Arundel county; and when the said road shall be opened as
is required by the provisions of this act, the commissioners
aforesaid, shall be required to report to the Levy court and
commissioners of their respective counties, the expense of
doing the same, and thereupon the commissioners of Anne
Arundel county, and the Levy court of Montgomery coun-

ty, are hereby authorised and required to levy upon the
assessable property of their respective counties aforesaid,
a sum of money sufficient to defray such expense; each
county paying the expense that may accrue within its own
limits.

Oath

Sec. 2. And be it enacted, That the said commissioners
before they proceed to open said road shall make oath or
affirmation, as the case may be, that they will faithfully
perform the duties reposed in them by this act, to the best
of their skill and judgment.

Compensation

Sec. 3. And be it enacted, That the commissioners of
Anne Arundel county, and the Levy court of Montgomery
county,are hereby authorised to allow to the commissioners
of each county respectively for opening this road, two dol-
lars per day for each day that they may be engaged therein
