CHAP. 195.

county, be, and they are hereby authorised at their annual
meeting, on the first Monday in April, in each and every
year, to contract with the lowest bidder for the repairs of
the public roads of said county or any part thereof, as in
their discretion they may deem best and most conducive to
the public interest, and to appoint overseers for such parts
of said roads as they may not see fit to put out on contract
in the manner now authorised by law.

Notice required

Sec. 2. And be it enacted, that it shall be the duty of
the clerk of the Levy court, when required by said court
to give notice in writing, at least three weeks before the
said first Monday in April annually, at not less than three
of the most public places in each election district in said
county, that the different sections of the public roads as
now laid off to the several overseers of said county, will he
offered to the lowest bidder iu the Town of Port Tobac-
co, on the. first Monday in April next, ensuing.

penalties, &c

Sec.3. And be it enacted, That Whenever any section
or portion of the said roads shall be put out on contract,
the person contracting therefor shall file with the clerk of
the Levy court of said county a written contract or instru-
ment of writing, designating the part or section of the said
public road contracted for, and the terms of said contract,
and each and every of said contractors shall be subject t o
the same penalties, fines and forfeitures, for neglect of duty
to which overseers of the public roads in said county are
subject under the existing laws.

Exemption from
labour

Sec. 4. And be it enacted, That when the said roads or
any section thereof may be placed under contract as afore-
said, that all and every person or persons now required to
work or furnish hands to work on said roads, on such sec-
tions so placed out on contract, be and they are hereby ex-
empt from furnishing said labor as required by the act to

Proviso

which this is a supplement; Provided always, that the said
Levy court shall in no instance contract to pay for the re-
pairs of any part or section of said public roads a greater
sum than is now by law allowed as compensation to the
overseer of said parlor section, unless they, the said Levy
court shall judge it expedient to put out the repairs of
the public roads of said county upon contract as aforesaid,
