1835.

Sec. 2. And be it enacted, That the commissioners afore-
said, or a majority of them shall ascertain the damages
which any individual may sustain by reason of the said
street being laid out and opened through his or her lots,
which shall be paid or secured to be paid before the said
street shall be opened.

CHAP. 168.

Respecting dama-

ges

Sec. 3. And be it enacted, That the damages which may
be ascertained as aforesaid, to be sustained by reason afore-
said, shall be paid or secured to be paid by the persons
conceiving themselves interested in opening the said street,
unless the Levy court of Worcester county shall be of
opinion, that the opening thereof is of that public benefit
so as to justify levying the same upon the county, in which
case the damages ascertained to be sustained by the indivi-
duals through whose lots the said street may be opened,
shall be levied upon the assessable property of the said
county for the benefit of the owners of the said lots respec-
tively.

Sec. 4. And be it enacted, That if the preceding sec-
tions are carried into effect, then Spence's alley shall be dis-
posed of at the discretion of the commissioners aforesaid,
and the proceeds arising therefrom shall be applied towards
defraying the expenses arising from the formation of the
street aforesaid.

opened the same shall be deemed and taken as a public
street torever thereafter.

An act relating to Monument Street, in the City of Balti-
more,

Passed Mar. 8,1834

SECTION 1. Be it enacted by the General Assembly of
Maryland, That unless Monument street, in the city of Bal-
timore, is opened and condemned, from Eutaw street to
Ross Street, in the manner now provided iov by law, within
and during the present year; it shall and, may be lawful to
