1833.

Burgess and Commissioners aforesaid, to contract and
agree with some person or persons on reasonable terms to
level, pave or repair such footways, and to charge the ex-
pense thereof to the owner or owners of the property in
front of which such work may be done, and shall recover
the same by distress on such property , with costs.

Sec. 11 And be it enacted, That the limits of Middle-
town or the said corpoiation shall extend to the distance
of one half a mile from the tavern aforesaid, each way; and
the property within said limits shall be subject to such
taxation and charges as may be deemed necessary by the
Burgess and Commissioners, or a majority of them, to
support and defray the expenses which may at any time
be incurred in the improvements of said town, except all
arable lands within said limits shall be free from such tax-
ation, so long as the same are not laid into town lots.

Sec. 12. And be it enacted, That the said Burgess and
Commissioners shall have power to levy a tax on the pro-
perty within the limits of said town, to such an amount as
may from time to time be deemed necessary to accomplish
the purposes aforesaid, which said tax shall be collected
and paid to the said Burgess and Commissioners, by a

collector annually by them appointed, who shall have the
same power to destrain therefor, as the collector cf the
county assessment has to destrain for the sune; and the
collector so appointed shall act in the capacity of a town
constable, and shall have full power and authority to pre-
serve the peace and good order of the said town, and for
that purpose he is hereby invested with the same power

bond with sufficient security to the said Burgess and Com-
missioners, for the true and faithful performance of his
duties as such; which said bond shall be liable, as consta-
bles' bonds are under the laws of this state.

Sec. 13. And be it enacted, That the said Burgess shall
receive and disburse all monies collected under any ordi-
nance or by-law of the said town, and shall give bond to
the commissioners, with such security as they shall require;
the said bond shall be liable in any court of law or equity
in this state; and the said Burgess of Middletown, shall
in virtue of his office, have and exercise, within the limits
of the corporation, all the jurisdiction and power of a jus-
