tions prepared by the engineer aforesaid, or according to any

plan or specification the proposer may submit, and the time

when such water works will be completed and ready for use,

or supplies and materials furnished. The said proposals shall

ten per centum of the amount of the proposal, to be returned

if the proposal be not accepted, and to be held if the pro-

posal be accepted, together with the bond hereinafter pro-

vided for, as security for the performance of the proposal.

The Commissioners may reject any and all bids, or accept

the proposal of any responsible bidder, at their discretion;

but they shall require any accepted bidder to enter into a

contract in writing with them, and to give bond with security

to be approved by them, in double the sum of said contract

price, conditioned for the faithful performance of the contract,

and they shall not pay, or cause to be paid, in advance

for any work not actually done ; and they shall not pay

for any work done unless it (the work) shall have been done

and the supplies and materials furnished strictly in accordance

with the plans and specifications signed and accepted by the

contractor and be first approved in writing by the engineer

and accepted in writing by the Commissioners. Furthermore,

water works are accepted by them, payment of five per centum

of their cost, in order to insure the establishment of the water

works in accordance with the plans and specifications of the en-

gineer and the contract of the contractor to save the town

harmless from any loss or failure or omission of the contractor

to fulfill in good faith his contract.

SEC. 9. And be it enacted, That at the election to be held in
