or supplies and materials furnished. The said proposals shall

The Commissioners may reject any and all bids, or accept

the proposal of any responsible bidder, at their discretion;
|

but they shall require any accepted bidder to enter into a
|

contract in writing with them, and to give bond with security
|
 
|
to be approved by them, in double the sum of said contract
|
 
|
price, conditioned for the faithful performance of the contract,
|
 
|
and they shall not pay, or cause to be paid, in advance
|
 
|
for any work not actually done ; and they shall not pay
|
 
|
for any work done unless it (the work) shall have been done
|
 
|
and the supplies and materials furnished strictly in accordance
|
 
|
with the plans and specifications signed and accepted by the
|
 
|
contractor and be first approved in writing by the engineer
|
 
|
and accepted in writing by the Commissioners. Furthermore,
|

the Commissioners shall withhold for one year from the date the

water works are accepted by them, payment of five per centum
|
 
|
of their cost, in order to insure the establishment of the water
|
 
|
works in accordance with the plans and specifications of the en-
|

gineer and the contract of the contractor to save the town
|
 
|
harmless from any loss or failure or omission of the contractor
|
 
|
to fulfill in good faith his contract.
|
 
|
SEC. 9. And be it enacted, That at the election to be held in
|

the town of Delmar, Maryland, on the second Tuesday in

that the question whether or not said town shall issue coupon

bonds to the amount of not more than ten thousand dollars

it shall be the duty of the Commissioners of Delmar to give
|
 
|
public notice of the intent of this Act in such manner and at
|
 
|
such time previous to the election as they may decide fit.

|
SEC. 10. And be it enacted, That the election provided for
