and labor furnished in pursuance of the provisions of this

the said water works and to superintend and to pass upon in
|
 
|
his person the kind, quality and character of all material and
|
 
|
labor used in the construction and maintenance of said water
|

works and compensate him therefor in such sum of money,

to be paid in such portions and at such times as they shall
|

order, first to be agreed upon in writing by and between him
|
 
|
and them ; provided, such compensation or portions thereof
|

so agreed upon or otherwise paid to him shall not exceed
|

five per centum of the actual costs of the said water works.

The plans and specifications shall be the property of the town
|
 
|
of Delmar, Maryland, and be filed in the office of the Com-
|
 
|
missioners and be open to inspection and examination by any
|
 
|
person interested, under the care of their clerk. The Com-
|
 
|
missioners shall invite sealed proposals for the construction
|

some newspaper for a reasonable length of time ; provided,

such advertisement appears in three successive issues of the En-

gineering News, a publication published in the City of New
|
 
|
York, State of New York, for at least two weeks before any
|
 
|
proposal or proposals shall be opened and considered. The
|
 
|
proposals shall be in sealed envelopes addressed to the presi-
|
 
|
dent of the Commissioners of Delmar, Maryland, and bear
|
 
|
on its face the inscription, "Proposals for Construction of
|
 
|
Water Works." The proposals shall be opened in the office
|
 
|
of the Commissioners by the clerk of the Town Commissioners
|
 
|
in their presence and such other persons, if any, who choose
|
 
|
to be present on the day and at the hour named in the ad-
|
 
|
vertisement for the proposals. Said proposals shall set forth
|
 
|
the amount of money for which the parties proposing will
|
 
|
construct and establish such water works, and any specified
|
 
|
sort or portion thereof, according to the plans and specifica-
