CHAPTER 411.

 

AN ACT to repeal and re-enact with amendments Sections

 

138 A and 138B of Article 15 of the Code of Public Local

 

Laws, title "Kent County." sub-title "Justices of the Peace

 

and Constables," as enacted by Chapter 161 of the Acts passed

 

at the January Session, 1902.

Re-enact-
ments.

SECTION 1. Be it enacted by the General Assembly of Mary-

 

land, That Sections 138A and 138B of Article 15 of the Code

 

of Public Local Laws, title "Kent County," sub-title "Justices

 

of the Peace and Constables," be and the same is hereby re-

 

pealed and re-enacted with amendments, so as to read as fol-

 

lows :

138A. It shall be the duty of the Governor, after the appoint-

Chestertown or Fourth Election District, and those of the First

 

Election District of Kent County, to select one from the justices

 

so appointed for each of said districts who shall be known and

 

designated as police justices; the said police justices shall have

 

the same jurisdiction in criminal cases as justices of the peace

 

now possess and which may hereafter be conferred upon them

 

by and under the laws of the State, but the police justice of

 

the First Election District shall have civil jurisdiction; the said

 

police justices shall have exclusive jurisdiction of and shall be

 

required to try and determine all violations of the criminal law

 

which may arise in the Fourth or Chestertown Election District

 

or the First Election District of Kent County, within the juris-

 

diction now possessed by justices of the peace or which may be

 

hereafter conferred upon them by law ; provided, nothing in

 

this bill shall give the police justice of First District any juris-

 

diction in the first precinct of First District, and all viola-

 

tions of any of the ordinances of the town of Chestertown ; the

 

First Election District subject, however, to the same right of

 

election to be tried by jury, notice of which must be clearly

 

given by said justice to the party before beginning trial, and

 

subject to the same right of appeal as now exists under the
