Acts of 1900 be and the same are hereby repealed and re-
|
 
|
enacted with amendments in sections and sub-sections as here-
|
 
|
inafter set forth.
|
Appointment
|
139. At the regular meetings after the annual election and
|
of police,
"street super-
|
qualification of the newly elected members of the City Council,
|

or as soon thereafter as practicable, the Mayor shall appoint,
|
torney, etc.

subject to confirmation by a majority of the Council, not more
|
 
|
than four persons as policemen, one person as street super-
|
 
|
visor, and one person as legal counsel for the Mayor and Coun-
|
 
|
cil, and one of the justices of the peace residing in said town
|
 
|
as police justice, all of whom shall hold office for one year from
|
 
|
the date of their respective appointments, or until their suc-
|
 
|
cessors are appointed and confirmed. The duties and compen-
|
 
|
sation of these appointees shall be such as prescribed by law
|
 
|
and by ordinance or resolution of the Mayor and Council from
|
 
|
time to time.

139. Sub-Section I. The said policemen and street super-
|

by the Council, residing in the said town, for the faithful per-
|
 
|
formance of their respective duties, for the enforcement of the
|
 
|
ordinances of the said town, for the enforcement of the laws
|
 
|
of the State relating to crimes and misdemeanors, and for the
|
 
|
preservation of peace and good order; and the certificate so
|
 
|
signed by the person taking this oath and signed by the justice
|
 
|
of the peace before whom the same may be taken shall be filed
|
 
|
with the clerk to the Mayor and City Council, and by him safely
|
 
|
kept.

139. Sub-Section 2. The said policemen and street super-
|

visor so appointed shall have all the police powers of constables,
|
 
|
and it shall be their duty to enforce all the by-laws, resolutions
|
 
|
and ordinances of the said city, and all the laws of the State
|
 
|
of Maryland relating to crimes and misdemeanors; provided,
|
 
|
that the Mayor shall have power to appoint special policemen,
|
 
|
with the same powers of regular policemen, for a term not ex-
|
 
|
ceeding forty-eight hours when he deems it necessary for the
|
 
|
preservation of the peace and good order of the city ; and in
|
 
|
case of his absence or disability to do so from any cause, then
|
 
|
the President of the Council shall have the power of appoint-
|
 
|
ment of special policemen as aforesaid ; and the duties of these
|
 
|
policemen and their compensation shall be fixed by the Mayor
|
 
|
or President making the appointment, as the case may be ; and
|
 
|
all fines and fees collected by them shall be handed over imme-
|
 
|
diately to the Treasurer of the city, with the names from whom
|
 
|
collected.
