improvement of said street; and the said Commissioners are

 

hereby authorized and empowered by and with the consent

 

of the City Council to contract in the name of the Mayor and

 

City Council of Cumberland, with the lowest responsible bidder

 

or bidders for the completion of the work herein provided for,

 

and are further authorized to require and take from the con-

 

tractor or contractors a bond payable to the Mayor and City

Contractors'

missioners, or a majority of them, may determine.

 

SEC. 5. And be it enacted, That the said Commissioners,

shall have power and authority to require the services of the

 

City Engineer of Cumberland to make the surveys, plats and

of additional compensation other than that now allowed to

 

such officer by the ordinances of the Mayor and City Council

 

of Cumberland.

 

SEC. 6. And be it enacted, That the said Commissioners, or

 

a majority of them, shall, as soon as said work is fully com-

 

pleted, make a report of their proceedings hereunder to the

 

Mayor and City Council of Cumberland together with dupli-

them, one of which plats shall be kept in the office of said

 

city, and the other filed and recorded among the Land Records

 

of Allegany County; said Commissioners shall levy and assess

 

the cost of curbing said street as extended and improved

 

against the abutting property owners, and such sums so levied

 

and assessed shall be payable by them respectively to the

 

Mayor and City Council ; and as to the remaining cost and ex-

 

penditures attending such improvements, the said Commis-

 

sioners shall designate in their report what sums shall be

 

paid by the City of Cumberland towards said work, and what

 

sums shall be paid by the Board of County Commissioners of

 

Allegany County, respectively, towards said work; and what-

 

ever sums then remain shall be apportioned amongst the own-

 

ers, in fee simple, of the property binding on Washington

 

street as extended; provided, however, the total amount ap-

 

portioned amongst said property holders shall not exceed one-

 

half of the entire cost of said improvements after deducting

 

the costs of said curbing as aforesaid; and provided, further,
