election shall, after having given five days' notice of the time

Board of Commissioners, and the person or persons receiving

the highest number of votes at said election shall, with those

previously chosen, if any2 constitute the Commissioners of

Hillsboro.

|
SEC. 9. And be it enacted, That if any vacancy shall occur
|
 
|
|
by death, resignation, removal or failure to act of one or more
|

missioners, or a majority of them, shall elect a proper person

to fill said vacancy.

SEC. 10. And be it enacted, That every Commissioner, be-

fore he proceeds to act as such, shall make oath before some

and faithfully, according to the best of his skill and judgment,

perform the duties of Commissioner without favor, partiality

or prejudice, and a certificate of such qualification shall be

returned by the said justice of the peace to the Commissioners,
|
 
|
|
to be filed and recorded among their proceedings.

|
|
SEC.11. And be it enacted, That the said Commissioners
|
 
|
|
shall meet at such place as they may appoint within said town
|

and as much oftener by adjournment as they shall deem ne-

SEC. 12. And be it enacted, That the said Commissioners
|
 
|
|
shall elect a president of their Board and annually appoint a

clerk, a chief bailiff and such number of under bailiffs at any
|
 
|
|
time, as they may deem necessary to properly preserve the
|
 
|
|
peace, a treasurer and one or more assessors of taxes, whose
|
 
|
|
duties and qualifications shall be as hereinafter prescribed.
|
 
|
|
SEC. 13. And be it enacted, That the president of said
|
 
|
|
Board of Commissioners shall preside at all meetings of the
|

cause, in which event the said Commissioners may select a

president pro tempore; he shall sign all by-laws and ordinances

of said Board of Commissioners, and shall countersign all

orders and drafts drawn by the clerk, under the direction of

the said Commissioners, on the treasurer of said town.

|
|
SEC. 14. And be it enacted, That the clerk shall be appointed
|
 
|
|
from among the citizens of said town, qualified to vote for
|
Clerk and his
duties.

Commissioners; he shall, before entering on his duties, make
|
 
|
|
oath before the said Commissioners, or any one of them, that he
