commander, a citizen of this or some one of the United States, and mariners
or seamen, belonging to and shipped on board such vessel for the
voyage, three fourths of whom shall be citizens of this state, or registered
as such, or citizens of some of the United States. |

XII. And be
it enacted, That every master or commander of any vessel
intended to take tobacco on board for exportation out of this state, shall
made known such intention to the naval officer of the district in which
such vessel shall be entered, or with whom such vessel is intended to be
cleared, and the master or commander, or chief mate, of such vessel, shall
each, before receiving any tobacco on board, make oath, or affirmation,
as the case may be, before the said naval officer, that he will not receive,
or permit to be received, on board the vessel of which he is master, commander
or mate, any tobacco not inspected and passed agreeably to the
directions of this act, or allowed to be exported by this act, and the
master or commander clearing out such vessel shall, at the time of clearance,
deliver to the naval officer, on oath, or affirmation, as the case may
be, as required by the eleventh section of the act, entitled, An act respecting
the commerce of this state, to prevent frauds in the customs,
and to direct the duty of naval officers, and to regulate the conduct of
masters and mariners of merchant vessels, three fair manifests in writing,
signed by such master or commander, which shall contain the name of the
port or place where the tobacco in such manifest mentioned shall be taken
on board, the name of the vessel and the tonnage thereof, and a true account
of all the tobacco laden on board such vessel, with the number of hogheads
containing the same, and the tare and net weight contained in each
particular hogshead, together with the marks and numbers stamped or
branded on each hogshead, with the name of the person by whom shipped,
and from what warehouse; and no such vessel shall be cleared out unless
such oath or affirmation has been made, and manifest delivered, as above
directed; and the naval officer shall, at the time of clearing such vessel,
deliver to the master or commander thereof one of the said manifests, certified
and attested by him, under his hand and seal of office, and annexed
to the clearance of such vessel, and on the said manifest shall be endorsed
the oath or affirmation of the master or commander of such vessel, testifying
the truth of such manifest, and which oath or affirmation shall be
made on or before the clearing such vessel, before the said naval officer,
and certified by him, or before some judge or justice of the peace, or
before
the consul (if any) of the kingdom or state for which such vessel
shall be cleared; and the said naval officer shall transmit one of the
said manifests to the governor and the council, and the third he shall
keep in his office. |

XIII. And,
to encourage the manufacturing tobacco within this state,
and the export thereof, Be it enacted,
That any tobacco manufactured
in this state, (that is, spun, cut, or shag, for chewing or smoaking, or
made into snuff,) may be exported out of this state free of all duty, provided
the person desiring to export any of the said species or kinds of manufactured
tobacco, shall deliver to the naval officer of the district in which such
manufactured tobacco shall be laden for exportation, a manifest thereof,
in which shall be expressed the number and marks of the case or package,
and the weight of the tobacco, and the species thereof, with an oath or
affirmation of the owner, or of some credible person, endorsed on the manifest,
to the truth thereof, and that the tobacco therein expressed was actually
manufactured within this state; provided no case or package of
such tobacco shall contain above two hundred pounds weight. |

XIV. And,
whereas under pretence of removing tobacco for inspection,
the same hath often been put on board vessels for exportation out of |
