appear to the commissioners that a major part of the proprietors of the

XVII. And be
it further enacted, That on any future application of any proprietor
or proprietors of the said lots to the said street commissioners to remove
the fences made as aforesaid, or such part of the same as he or they
may state
as conducive to the interest of the said Addition, that thereupon they
shall
grant their assent in writing, and record the same, with the application;
provided
nevertheless, that it shall have appeared to the said commissioners that
the said removal may be conducive to the interest of the said Addition;
and
thereupon the applicants, or either of them, may remove the obstructions
granted
to be removed; provided always, that previous notice shall be given to
the
party concerned, that he or they may have an opportunity to remove the
same. |

CHAP. LX.
An ACT empowering the wardens of the port of Baltimore to
levy and collect the duty therein mentioned. |

WHEREAS many useful regulations have taken place
in consequence
of the powers heretofore granted to the wardens of the port of Baltimore;
and to enable them to carry the said regulations into full
effect, |
Preamble. |
II. Be it enacted,
by the General Assembly of Maryland, That the wardens of
the said port of Baltimore shall have full power and authority to assess,
levy
and collect, on every vessel arriving at the said port of Baltimore,
of sixty tun
or more, a sum of money not exceeding two cents per tun, to be appropriated
and applied by the said board of wardens to carry into effect the rules
and regulations
which they may, from time to time, make, respecting the harbour
and port of Baltimore. |

III. And be
it further enacted, That so much of the act of assembly, entitled,
An act appointing wardens for the port of Baltimore-town, in Baltimore
county,
which empowers the said board of wardens to assess and levy a duty of one
penny per tun on every vessel entering or clearing at the said port; and
also so
much of another act of assembly, entitled, A supplement to the act, entitled,
An act appointing wardens for the port of Baltimore-town, in Baltimore
county,
which empowers the board of wardens to assess, levy and collect, on every
vessel arriving at the said port of Baltimore, except pilot boats and vessels
not
coming from sea belonging to citizens of this state, a sum of money
not exceeding
two-pence current money per tun, be and are hereby repealed. |

IV. Provided
always, That this act of assembly shall not operate and take
effect until the same be raised and confirmed by an act of the congress
of the
United States. |

CHAP. LXI.
An additional supplementary act to an act, entitled, An act to
regulate the inspection of tobacco. |

WHEREAS in some of the counties of this state the
inspectors of tobacco
settle their accounts with the levy courts which happen before
November, and before the bulk of the tobacco of the inspection of
each year is shipped off, by which means the inspectors retain considerable
sums
of public money in their hands longer than necessary; to remedy which, |

by the General Assembly of Maryland, That the inspectors
of tobacco in each county of this state on the western shore, except Harford,
Calvert, and Saint-Mary's counties, who are now directed by law to settle
their
accounts before November, shall settle the same with the levy court
on the fourth
Tuesday in November annually, and that the levy courts in each county as |
