LAWS of MARYLAND.
supply of carriages and teams, and will not admit the delay which may
arise on
an attempt to provide the same by hire or contract, as aforesaid, then
the said justice
shall issue his warrant or warrants to the constable or constables aforesaid,
requiring
him or them immediately to press the whole number of carriages and
teams as shall be mentioned in the said warrant or warrants; and if any
justice,
after such application as aforesaid, shall wilfully refuse or neglect to
grant such
warrant as aforesaid, or if any constable shall wilfully refuse or neglect
to execute
such warrant, or if any person whose carriage, team or driver, has been
hired as
aforesaid, or whose carriage, team or driver, has been impressed as aforesaid,
shall
wilfully delay to furnish or forward such carriage, team or driver, to
such place as
he shall be directed by the said constable, such person so offending shall
forfeit and
pay a sum of money not exceeding fifteen pounds, nor less than three pounds
fifteen
shillings current money, one moiety thereof to the use of the poor of the
county
where such offence shall be committed, and the other half to the informer,
to be
recovered before any justice of the county, and to be levied on the offender's
person,
goods or chattels. |
Carriages carrying
provisions,
&c. not
to be prest. |
III. And be
it enacted, That no carriage, team, or driver of the same, carrying
provisions or articles of commerce to the army, or any city or town, shall
be liable
or subject to be prest for the public service; nor shall any waggon, team
or
driver, returning from such army, city or town, to which they had carried
such
articles aforesaid, be liable or subject to be prest as aforesaid, in case
waggons and
teams sufficient for the purposes aforesaid can be otherwise procured. |

the burthen
shall not fall
disproportionably. |
IV. And be it
enacted, That when a timely application for carriages and teams
shall be made, and circumstances will admit, the justice to whom such application
shall be made, shall issue his warrant or warrants aforesaid, to the constable
or
constables aforesaid, in such manner, and in such rotation, as that the
burthen
shall not fall on any one hundred in the county, or disproportionably or
oppressively
on any individual. |
Officers not to
require more
carriages for a
regiment than
will carry ten
tun, &c. |
V. And be it
enacted, That no officer shall apply for or require, of any justice
aforesaid, more carriages for the baggage of a complete regiment than what
will
be sufficient to carry ten tun, or more than the like proportion for
the baggage of
a greater or lesser number of forces; nor shall apply for or require more
carriages
for the removal of military stores and provisions, or sick or wounded soldiers,
than
what will be sufficient for the purpose. |
Owners to be
paid 30 s. a
tun per day,
&c. |
VI. And be it
enacted, That the owner of any carriage, team and driver, which
shall be capable of carrying one tun, and travelling twenty miles per day,
and
which shall be hired or prest as aforesaid, shall be paid at the rate of
thirty shillings
per day for every day such carriage, team and driver, shall be returned
in the
service; and the owner of any carriage, capable of a greater or less burthen,
and
travelling a greater or less distance, shall be paid in the like proportion
till discharged;
but if provision and forage be found by the public for the driver and
teams of such carriages, the expence thereof shall be deducted out of the
pay aforesaid;
and the owner of every carriage and team, capable as aforesaid of carrying
one tun, and travelling as aforesaid twenty miles per day, shall, after
the discharge
of the said carriage and team, be paid at the rate of one shilling per
mile from the
place of discharge to the place where such carriage and team was prest;
and the
owner of every carriage and team, capable of a greater or less burthen,
and travelling
a greater or less distance, shall be paid per mile in the like proportion. |
Carriages not
to travel more
than 60 miles. |
VII. And be
it enacted, That no carriage which shall be prest by virtue of this
act, shall be obliged to travel more than sixty miles beyond the place
where the
same was prest. |
Any judge,
&c. may issue
his warrant to
constables to
hire or press
boats, &c. |
VIII. And,
to expedite the transportation of troops, with their military stores
and baggage, up, down and across the bay, Be
it enacted, That any judge, member
of the council, or justice of the peace, within any county, from, near
or to
which, any battalion, detachment, troop or company, employed in the service
