The truth of the matter in Controversye between the partyes aforesaid by the
Court here being fully heard understood and Maturely Deliberated etc. It is there-
upon Considered that the Said William Westrey take nothing by his Said writt
but be in mercy for his false Clamor and that the Said John Soaper goe thereof
without Day etc. It is Likewise Considered that the Said John Soaper Recover
against the Said William Westrey his Damages by occation of the premises to two
hundred ninty one pounds of tobaccoe to the Said John Soaper by the discretion
of the Justices here att his Request for his Cost and Charges in this behalfe
Sustained According to the forme of the Stattute etc. by the Court here Adjudged
etc.

John Deakins plantiffe: Richard Brightwell Defendant.

Prince Georges County Ss. Richard Brightwell of the County aforesaid
Gentleman was Atteched to Answe[r] unto John Deakins of a plea of trespass
upon the Case etc.

Whereupon the Said John by William Bladen his Attorney Complayneth and
Saith that the Said [88] Richard the 20th day of October 1694 within the
Jurisdiction of this Court Standeing indebted unto the Said John in the Sume of
1040 lbs. of tobaccoe as by a pertickeler Account here in Court brought may more
at Large Appeare did then and there Assume upon himselfe and to the Said John
Faithfully promise that he the Said Richard the aforesaid Sume of 1040 lbs. of
tobaccoe unto the Said John hee would well and truly Content and pay when
thereto Required and the Said John in fact Saith that the Said Richard the Sume
of 455 lbs. of tobaccoe unto him the Said John did pay but as to the Sume of five
hundred Eighty pounds of tobaccoe residue of the Said Sume of 1040 lbs to
tobaccoe the Said Richard Although often Demanded to witt the day yeare and
place aforesaid unto the Said John did not pay but the Same to pay doth Still
denye and refuse to the damage of the Said John 1000 lbs. of tobaccoe and there-
upon he brings this Suite etc.

And the Said Richard Brightwell by Joshua Cecell his Attorney Cometh and
defendeth the force and Injury when etc and prayeth Leave thereof to Imparle
untill next Court and it is granted unto him the Same Day is given to the Said
John Deakins, etc.

Att which Said next Court (to witt) the 24th day of November Annoque
Domini: 1696 here Came the aforesaid parties by their Attorneys aforesaid and the
Said John Deakins prayeth that the Said Richard Brightwell to his Decleration
aforesaid may Answer etc.

And the Said Richard Brightwell by Joshua Cecell his Attorney Commeth and
Defendeth the force and Injury when etc. And Saith that he is not Informed by
the Said Richard Brightwell his Clyant of any Answer for the Said Defendant in
the plea aforesaid to be given and nothing more thereof Saith by which the Said
