[87] William Westry plantiffe: John Soper Defendant.
Prince Georges County Ss. John Soaper Late o£ the County aforesaid planter
was Atteched to Answer unto William Westrey of a plea of trespass upon the Case
etc.
And the Said William Westrey by William Bladen his Attorney Complaines
that the Said John Soaper the 27th day February Annoque Domini 1695: [1696]
att Charles Towne within the Jurisdiction of this Court Stood Indebted unto the
Said William Westrey in the Sume of two hundred and fifty two pounds of
tobaccoe and an halfe as by a pertickeler Account thereof here in Court brought
may more at Large Appeare And the Said John being Soe Indebted the Day yeare
and place aforesaid did Assume upon himselfe and to the Said William Westrey
did faithfully promise that he the Said John the aforesaid Sume of 252 lbs. of
tobaccoe when he Should be thereunto Required unto the Said William Westrey
he would well and truly Content and pay Nevertheless the Said John his promise
and Assumption Soe as aforesaid made Little Regarding but minding and frudu-
lently Intending him the Said William Westrey in this behalfe Craftily and
Subtilly to Deceive only fifty pounds of tobaccoe part of the Said Sume of 252 1/2
lbs. of tobaccoe unto the Said William Westrey afterwards the day and place
aforesaid did pay but as to 202 lbs. of tobaccoe and an halfe residue of the Said
Sume of 252 1/2 lbs. of tobaccoe unto the Said William Westrey Although often
thereto Required (to witt) Afterwards the day and place aforesaid hath not paid
but the Same to pay doth Still Denye and Refuse to the Damage of the Said
William Westry 500 lbs. of tobaccoe and thereupon he brings this Suite etc.

The above Account in Common forme proved in open Court by the oath of
William Westrey.
And the Said John Soper by William Stone his attorney Cometh and Defendeth
the force and Injury and prayeth Lycence thereof to Imparle here untill next
Court and it is granted unto him the Same day is given to the Said William
Westrey etc.
Att which Said next Court (to witt) the 24th day of November Annoque
Domini: 1696 Came as well the Said William Westrey as the Said John Soaper by
their Attorneys aforesaid and the Said William Westrey prayeth that the Said
John Soaper to his Decleration aforesaid may Answer etc. And the Said John
Soaper by William Stone his Attorney Cometh and Defendeth the force and
Injury when etc. And Saith that the Said John Soaper did not Assume in manner
and forme as the plantif[fe] in his Decleration aforesaid doth Complaine and of
this he puts himselfe upon the Court. William Stone
