unto the Said Westrey hath not paid Although often Demanded Afterwards
(Viz.) the day year and place aforesaid but the Same to pay doth yett denye
and Refuse to the Dammage of the Said William Westrey 1200 lbs. of tobaccoe
and thereupon he brings this Suite etc.

And the Said Thomas Sprigg by John Merriton his Attorney Cometh and
defendeth the force and Injury and prayeth Lycence thereof to Imparle here
untill next Court and it is granted unto him the Same Day is given to the
plantiffe Likewise etc.

Att which Said next Court (to witt) the 24th day of November Annoque
Domini 1696 Came here As well the Said William Westrey as the Said Thomas
Sprigg by their Attorneys aforesaid and the Said William Westrey prayeth that the
Said Thomas Sprigg to his Decleration aforesaid may Answer etc. And now here
att this day the Said Thomas Sprigg by John Merriton his Attorney aforesaid
Cometh and Defendeth the Said force and Injury when etc. and Saith that the
Said Thomas Sprigg has well and truly paid the Said William Westrey the Said
680 lbs. of tobaccoe in the Decleration aforesaid Expresed and of this he putts
himselfe upon the County. John Meriton.

Therefore Command is given to the Sheriffe that without Delay he Cause to
Come here twelve etc. by whome etc. and who nither etc. to Recogniz etc. because
as well etc.

And now here att this Day (to witt) the 24th Day of November Annoque
Domini 1696 here Came as well the Said William Westrey as the Said Thomas
Sprigg by their Attorneys aforesaid and the Jurors thereon Impannelled being
Called Likewise Came (to witt)

James Stoddart foreman, John Chittam, Archibald Edmonson, Samuell Ma-
gruder, William Powell, Joshua Hall, John Demall, John Browne Carpenter,
John Browne, Jr., Hugh Ryley, Matthew Mockeboy, Thomas Plumer. Sum-
moned per Thomas Greenfeild Sheriffe.

Who to Speake the truth Concerning the premises being Elected tryed and
Sworne upon their oaths doe Say that the Defendant doth not owe to the Said
plantiffe the Said Sume of Six hundred and Eighty pounds of tobaccoe as the
Defendant above in his plea aforesaid hath Alledged etc.

Therefore it is Considered that the Said William Westry take nothing by his
Said writt but bee in mercy for his false Clamour etc. And that the Said Thomas
Sprigg goe thereof without day etc. It is Likewise Considered that the Said
Thomas Sprigg Recover agaist the Said William Westrey his damages by Occation
of the premises to Eleven hundred and Seaven pounds of tobaccoe to the Said
Thomas Sprigg by the discretion of the Justices here att his Request for his Cost
and Charges in this behalfe Sustained According to the forme of the Stattute etc.
by the Court here Adjudged etc.
