tenn dayes for Each of the Said Seaven days he Absented himselfe from his Said
masters Servis According to Act of Assembly etc.
Upon a motion made to Court here by James Stoddart and Josias Towgood
the Suretys for Thomas Duleys good behavour and Appearance the next Court
as by their Recognizance in this Court Records Appeareth that they heard that
the Said Thomas Duley Should Say that he would Run away and Leave his Said
Suretyes in the Lurch humbly prayes that the Said Thomas Duley may be againe
Committed into the Sheriffes Custody untill he Shall find other Suretyes and that
they may be discharged from their Said Recognizance Whereupon the Said
Thomas Duley being Called Came into Court in his proper person and was com-
mitted into the Custody of the Sheriffe untill he Should find other Suretyes for
his good behavour and Apppearance the next Court as aforesaid and that the
Said James Stoddard and Josias Towgood be discharged from their former
Recognizance etc.
Then Did the Court Adjourne untill Eight of the Clock tomorrow morning
and then mett and Satt (Viz.)
Present. Mr. Thomas Hollyday, Mr. William Barton, Mr. John Wighte, Mr.
Robert Bradley, Mr. David Small, Mr. William Tanyhill, Mr. Robert Tylor,
Commisoners.
Mr. Thomas Hollyday Present here in Court made his Complaint against
Capt. Henry Munday for writeing a warrant and Signing the Same with his name
Alledging that it was an abuse to his Majesty the tennor of which Said warrant
followes in these words (Viz.) Sir: these in his Majestys name are to Requier you
to bring before us the body of D: M: for a Sertaine Fact Committed, per
me Henry Munday.
To Mr. David Small these. Constable Daniell Troy.
But all the Court Except Mr. Thomas Hollyday thought it a Frivelous thing
and ought to bee tooke no notice off they haveing Consulted with Mr. Bladen the
Kings Attorney about the Same.
William Westry plantiffe: Thomas Sprigg Defendant.
Prince Georges County Ss. Thomas Sprigg of the County aforesaid planter
was Atteched to Answer unto William Westrey of a plea of trespass upon the
Case etc.
And whereupon the Said William Westry by William Bladen his Attorney
Comes and Complayneth [86] that the Said Thomas the 20th day of November
Annoque Domini 1695 within the Jurisdiction of this Court Standing Indebted
unto the Said William Westry in the Sume of 680 lbs. tobaccoe as by a pertickeler
Account thereof here in Court brought whose date is as above relation being
thereto had may more att Large Appeare And the Said Thomas being Soe In-
debted did then and there Assume upon himselfe and to the Said William
Westrey faithfully promise that he the Said Thomas the Said Sume of 680 lbs.
tobaccoe unto him the Said William Westrey when he Should be thereunto Re-
quired he would would well and truly Content and pay Nevertheless the Said
Thomas his promise and Assumption as aforesaid made not Regarding but
plotting and intending him the Said William Westrey in that behalfe Craftily
and Subtilly to deceive and defraud the aforesaid Sume of 680 lbs. of tobaccoe
