the Said Anthony Smart did not Assume in manner and forme as the plantiffe
in his decleration aforesaid hath declared and of this he putts himselfe upon

Therefore it is Commanded the Sheriffe that without Delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because
as well etc. And now here att this Day that is to Say the 24th day of Noveber:
Annoque Domini 1696. here Came as well the Said William Powell as the Said
Anthony Smart by the Attorneys aforesaid and the Jurors thereon Impanelled
being Called Likewais Came (Viz.)
James Stoddard, foreman, John Chittam, Archibald Edmonson, Samuell Ma-
gruder, Thomas Sprigg Jr., Joshua Hall, John Demall, John Browne Car-
penter, John Browne Jr., Hugh Ryley, Charles Hay, Thomas Plumer. Sum-
moned per Thomas Greenfeild, Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne upon their oaths doe Say that the Said Defendant doth owe to the Said
William Powell the Said five hundred Sixty nine pounds of tobaccoe as the Said
plantiffe above in his decleration hath declared.
Therefore it is Considered that the Said William Powell doe Recover against
the Said Anthony Smart his damages by occation of the premises aforesaid to
five hundred Sixty nine pounds of tobaccoe by the Jurors aforesaid in forme
aforesaid Assessed and alsoe the Sume of twelve hundred and Six pounds of
tobaccoe to the Said William Powell at his Request for his Costs and Charges in
this behalfe Expended by the Court here Adjudged and the Said Anthony Smart
in mercy etc.
Hugh Montgomery plantiffe: Charles Tracy defendant.
The plantiffe brought his Majestyes writt against the Defendant for Eight
hundred pounds of tobaccoe due upon bill which to him he oweth and unjustly
Deteyneth etc, hath not procecuted his Said writt with Effect etc.
Therefore hee and his pledges of procecuteing be in mercy etc. Lett the names
of the pledges be Sought etc. and the Said Charles Tracy goe thereof without
day etc. It is Likewise Considered by the Court here that the Said Charles Tracey
recover against the Said Hugh Montgomery his damages by occation of the
premises to two hundred ninty Seaven pounds of tobaccoe to the Said Charles
Tracy by the discretion of the Justices here att his Request for his Cost and
Charges in this behalfe Sustained According to the forme of the Stattute etc.
by the Court here Adjudged etc.
Richard Brightwell plantiffe: Francis Durham Defendant:
The plantiffe by William Stone his Attorney brought his Majestys writt
against the Defendant in a plea of trespass upon the Case etc. And hath not
procecuted his Said writt therefore he and his pledges of procecuting be in
mercy etc. Lett the names of the pledges be Sought etc. and the Said Francis
Durham goe thereof without Day etc.
[75] It is Likewise Considered that the Said Francis Durham Recover against
the Said Richard Brightwell his Damages by Occation of the premises to Six
hundred and Seaventeene pounds of tobaccoe to the Said Francis Durham by
the discretion of the Justices here att his Request for his Costs and Charges in
