William Powell plan tiff e: Anthony Smart defendant.

Princes Georges County Ss. Anthony Smart Late of Prince Georges County
planter was Atteched to answer unto William Powell of a plea of trespass upon
the Case etc.

And Whereupon the Said William by William Stone his Attorney Com-
plaineth that whereas the Said Anthony the first day of November in the year
of our Lord 1695 att Charles Towne within the Jurisdiction of this Court was
Indebted unto the Said William in the Sume of five hundred Sixty and nine
pounds of tobaccoe being for Severall goods by the Said William to the Said
Anthony Sould and delivered as by a pertickeler Account thereof here Ready
in Court to be produced more att Large may Appeare and the Said Anthony
to the Said William in manner aforesaid being Indebted in consideration thereof
did Assume upon himselfe and to the Said William then and there Faithfully
promise that he the Said Anthony the Said Sume of 569 pounds of tobaccoe to
the Said William when hee Should be thereunto Requested would well and
truly Content and pay Nevertheless the Said Anthony his promise and Assump-
tion aforesaid not att all Regarding but minding and Fraudulently Intending
him the Said William in this behalfe Craftily and Subtilly to deceive and
defraud the Said Sume of 569 lbs. of tobaccoe to the Said William hath not
paid Although the Said Anthony afterwards the day and place aforesaid and
att Severall other dayes and times to doe the Same by the Said William was often
thereunto Requested but hitherto Refused and Still doth Refuse to the damage
of the Said William of 1000 lbs. of tobacco and thereof he bringeth his Suite etc.

[74] And the Said Anthony Smart by Cleborn Lomax his Attorney Cometh and
defendeth the force and Injury when etc. And prayeth Lycence thereof to Im-
parle untill next Court and it is granted unto him the Same Day is given to
the plantiffe Likewise.

Att which Said next Court (to witt) the 24th day of November Annoque
Domini 1696 Came here as well the Said William Powell as the Said Anthony
Smart by their Attorneys aforesaid and the Said William Powell prayeth that
the Said Anthony Smart to his Decleration aforesaid may Answer etc. And now
here att this day the Said Anthony Smart by his Said Attorney aforesaid Cometh
