And the Said David Small Administrator aforesaid Came here into Court in
his proper person and defendeth the force and Injury when etc. And Saith that
he hath not Assetts of the Deceased [64] [in] his hands to Sattisfie the
plantiffes Debt by Accompt before Expressed but desired there might be Judg-
ment when Assets Entred for the Same etc.

Therefore it is Considered that the Said Charles Tracy doe Recover against
the Said David Small his debt for Damages aforesaid and his damages by occa-
tion of deteyning the Said Debt to the Sume of two hundred twenty and two
pounds of tobaccoe to the Said plantiffe of his Assent by the Court here Ad-
judged to be Leavied of the goods and Chatties which were of the Said William
Copers att the time of his Death and which to the hands of the Said David
Small in time to Come Shall happen to Come to be Administred and the Said
David Small in mercy etc.

The plantiffe Sues the Defendant in his proper person in a plea of trespass
upon the Case for the Sume of thirteen hundred and Eighty pounds of tobacco
a Certaine Debt for Damages upon the ballance of Accounts as by an Accompt
thereof here Recorded and Decleration filed Appeareth.
