66 PRINCE GEORGES COUNTY

Cost and Charges in this behalfe Laid out and Expended According to the Act
of Assembly in Such Cases made and provided and by the Court here it is
granted unto him.

[Char]les Tracey plantiffe: [Ri]chard Hullse Defendant.

Prince Georges County Court Ss. Richard Hulse Late of Prince Georges
County Inholder was Sumoned to Answer unto Charles Tracey of a plea that
hee Render unto him a Certaine Large boate Called a Flatt to the vallew of
three thowsand pounds of tobaccoe which he unjustly Deteynes from him etc.
[63] And Whereupon the Said Charles Tracey by Joshua Cecell his Attorney
Sayes that he the Said Charles Tracey the 29th day of September in the year of
our Lord 1696 att Charles Towne within the Jurisdiction] of this Court de-
livered to the aforesaid Richard Hulse a Certaine Large boate Called a Flatt
to the vallew of three thowsand pounds: of tobaccoe to be Safe kept and to him
the Said Charles Tracey when he Should be thereunto Required to be delivered
Yett the aforesaid Richard Hulse Although often Required to the Said Large
boate Called a Flatt to the vallew aforesaid to him the Said Charles Tracey he
hath not as Yett redelivered but the Same to him hitherto to deliver hath
denyed and as yett doth denye and unjustly Deteyne whereupon the Said
Charle[s] Tracey Sayes that he is Damnified and hath Damage to the vallew
of 4000 lbs. of tobaccoe and thereupon he brings his Action.

Pledges etc. John Doe, Richard Roe. Joshua Cecell for the plantiffe.

And the Said Charles Tracey haveing Issued out one writt against the De-
fendant and alsoe Caused a Coppy of the Cause of Action to be Left att the
house were the Said Richard Hulse Last was at in this County which Said writt
was by the Sheriffe of this County Returned that the Said Richard Hulse was
not to be found in his balywick upon which on part of the Said Charles Tracey
it is testified here in Court that the Said Richard Hulse hath Elloined himselfe
out of this province Whereupon the Said Charles Tracey by his Attorney afore-
said prayeth an Attechment against the goods Chatties and Creditts of the Said
Richard Hulse as well for the Said Sume of three thowsand pounds of tobaccoe
the debt for Damages for deteyning of the boate or Flatt aforesaid as alsoe the
Sume of Seaven hundred forty one pounds of tobaccoe his Cost and Charges
in this behalfe Laid out and Expended According to Act of Assembly in Such
Cases made and provided and by the Court here it is granted unto him.

Charles Tracey plantiffe: David Small Administrator of Mr. William Cooper
Defendant.

The plantiffe by Joshua Cecell his attorney demanded to file a bill against
Mr. David Small gentleman one of the Justices of this Court Administrator of
the goods and Chatties of William Cooper Late of Prince Georges County gentle-
man Deceased in a plea of trespass upon the Case for fifteen hundred fifty and
three pounds of tobaccoe one halfe pound of tobaccoe due by an Account as by
an Account hereafter Expressed and bill filed Appeareth.

Mr. William Cooper Debtor to Charles Tracey June the fourth 1696.
