602 PRINCE GEORGES COUNTY

And the Said Thomas Taney by Joshua Cecell his Attorney comes and defends
the force and Injuey when etc. and prayeth Lycence thereof to Imparle here
untill the next Court comeing and it is Granted unto him the Same time is given
to the Plantive Likewise.

And now here att this day came as well the Said James Moor as the Said
Thomas Tany by his Attorney aforesaid and the Said James Moor Prayeth that
the Said Thomas Taney to his writt of Scire Facias may answer.

The Truth of the matter in Controversie between the Parties aforesaid by the
Court here being Seen heard understood and Maturely Deliberated it is Con-
sidered that the Said James Moor have Execution against the Said Thomas Tany
for the Debt aforesaid Togather with one hundred Ninety two pounds of Tobacco
for his Costs and Charges Laid out and Expended etc.

James Moor Plantiff: Thomas Tany and uxor Defendant

It was Commanded the Sheriff that whereas there was due from Thomas Taney
and uxor the Sume of two hundred Sixty five pounds of Tobacco unto James
Moor allow'd him upon a Nonsuit he the Said Moor Obteined att a Court held
att Charles Towne the fourth Tuesday in March in the year 1697 before the
Justices of our Sovereigne Lord the King in the Said County And for the Said
Debt Execution hath not Ishued forth against him the Said Tany for the Same
he make Knowne unto him that he be and appear before the Justices of the Said
County the 4th Tuesday in August Last past to Shew Cause if any he have why
the Said James Moor Execution against him for the Debt aforesaid Should not
have and that he had then and there this writt.

And the Said Thomas Tany and uxor by Joshua Cecell their Attorney comes
and defends the force and Injury when etc. and prayeth Lycence thereof to im-

And Now here att this Day to witt the 26th day of Sept. 1699 came here as well
the Said James Moor Plantiff as the Said Thomas Tany and uxor by their
attorney aforesaid and the Said James Moor Prayeth that the Said Thomas Taney
to his writt of Scire facias may answar.

from Thomas Taney and Jane his wife the Administratrix of Henry Truman
Late of Callvert County Deceased the Sume of two hundred Sixty and five
pounds of Tobacco occationed by a non suite the Said James Moor Obteined
against the Said Thomas and Jane as administratrix of the Said Truman att a
Court held att Charles Towne the fourth Tuesday in March in the year 1697
And for the Said Debt Execution hath not Ishued forth against him for the
Same he make Knowne unto the Said Thomas and Jane that they be and appear
before the Justices of our Said County to Shew Cause if any they have upon the
fourth Tuesday in August Last past why Execution against them for the Debt
aforesaid shall not have and that he had then and there this writt.
