And now here at this day (to witt) the 26th day of September Annoque Domini
1699 came as well the Said David Small administrator as aforesaid by Joshua
Cecell his Attorney Plantiff as the Said Elisha Sedgewick by William Stone his
Attorney and the Auditors Likewise came and made repoart of their auditt as
(viz.)

Per Abatement aftar regulation one hundred pounds of Tobacco, per us.
William Hutchison, Robert Bradley.

Therefore it is Considered by the Court that the aforesaid David Small adminis-
trator of all and Singular the Goods Chatties and Credditts of Charles Treacy
Deceased recover against the Said Elisha Sedgewick Executor of the Last will and
Testament of Robert Brothers Deceased as well the Sume Nine hundred twenty
Seven pounds of Tobacco his Debt aforesaid as allso the Sume of two hundred
Seventy and four pounds of Tobacco for his Costs and Charges of Suite to the
Said David Small Plantife of his Assent by the Court here adjudged out of the
Goods and Chatties whereof Robert Brothers att the Time of his Death in the
hands of the Said Elisha Sedgewick if he hath soe much in his hands and the Said
Elisha Sedgewick in Mercy.

Robert Mason Plantiff: Nathaniell Jenkison Defendant

Robert Mason who brought his Majesties writ against Nathaniell Jenkison in
a Plea of Tresspass upon the Case for that he hath not Prosecuted his Said writt.

Therefore it is Considered that the Said Robert Mason Plantiff and his Pledges
of Prosecuteing be in Mercy And lett the Names of the Pledges be Sought for and
that the Said Nathaniell Jenkison goe therof without day etc.

It is Likewise considered that the Said Nathaniell Jenkison Defendant doe
recover against the Said Robert Mason Plantiff the Sume of three hundred twenty
Seven pounds of Tobacco his Damages by Occation of the Premisses By the Dis-
cression of the Justices heer to the Said Nathaniell Jenkison Defendant for his
Costs and Charges by him in this Part Susteined according to the forme of the
Statute etc. by the Court here adjudged etc.

Jonathan Willson Executors Plantiffs: John Rooke Defendant

The Plantiffs in their Propper Persons brought his Majesties writt of Capias
against the Defendant in a Plea of Tresspass upon the Case it being for four
Pounds four Shillings and Seven pence Sterling as by Declaration Filed and
account here Entred may appear.
