bill or Wrighting obligatory Sealed with the Scale of the Said Hugh and here
in Court produced whose Date is the Day and year aforesaid [489] did
obleidge himselfe his heires Executors Administrators to Pay or Cause to be paid
unto the Said John Meryton his heires Executors administrators and assignes
the full and Just Sume of Six hundred pounds of Tobacco convenient in the
Said County Notwithstanding which the Said Hugh the Said Sume of Six hun-
dred pounds of Tobacco to the Said John hath not Paid all hough often de-
manded but the Said Sume of Six hundred pounds of Tobacco to him the Said
John to pay hitherto hath denyed and Still doth denye whereupon the Said John
Saith he is Damnifyed and hath Loss to the value of twelve hundred pounds of
Tobacco and whereupon he brings his Suit etc.
Pledges to prosecute. John Doe, Richard Roe. Meryton pro Querens
And the Said Hugh by Joshua Cecell his Attorney cometh and Defendeth
the force and Injury when etc. and Prayeth Lycence thereof to Imparle untill
the next Court and it is Granted unto him the Same day is given to the Said
John Meryton Likewise. Att which day (to witt the 26th day of September
Annoque Domini 1699 here came as well the Said John Meryton in his propper
Person as the Said Hugh Reyley by Joshua Cecell his attorney afforesaid and
the Said John Meryton Prayeth that the Said Hugh Reyley to his Declaration
aforesaid may answer.
And the Said Hugh Reyley by Joshua Cecell his attorney cometh and De-
fendeth the force and Injury when etc. and Saith that he doth not owe the Said
Plantiff the Said Six hundred pounds of Tobacco or any Part thereof as the
Said Plaintiffe hath Declared against him and of this he putts himselfe upon
the Court. Joshua Cecell.
And the Plaintiff allso. Meryton in propria persona.
Whereupon the Court haveing haveing read and Fully understood the alliga-
tions of the Parties on both Sides and the wittnesses on both Sides being fully
heard by the assent of the Parties afore Saids.
Therefore it is Considered by the Court that the Said John Meryton Plantiff
take nothin by his Said writt but be in mercy for his Fake Clammor and lett
the Names of the Pledges be Sought for and the Said Hugh Reyly Defendant
goe thereof without day It is Likewise Considered that the Said Hugh Reyly
Defendant doe recover against the Said John Meryton Plantiffe the Sume of
two hundred Eighty Nine pounds of Tobacco his Damages by Occation of the
Premisses by the Discression of the Justices here to the Said Hugh Reyley De-
fendant for his Cost and Charges by him in this part Susteined according to
the forme of the Statute etc. by the Court here adjudged etc.
Thomas Wheler Plantiff: Nicholas Sporne Defendant
Thomas Wheeler by William Stone his Attorney brought his Majesties writt
against Nicholas Sporne in a plea of Debt due by bill for the Sume of Nine
hundred pounds of Good Sound Merchantable Tobacco which to him he oweth
and from him unjustly deteineth etc. as by Declaration Filed and bill Filed
dated the Sixth day of December Annoque Domini 1698 may appear.
And the Said Nicholas Sporne by Joshua Cecell his Attorney comes and de-
fends the force and Injury when etc. and Prayeth Lycence to imparle here untill
the next Court Coming and it is Granted unto him the Same Day is Given to
the Plantife Likewise Att which day (to witt) the 26th day of September anno-
