Ordered that a Venire goe forth for Godfrey Barnes and Mary Dunhue to
appear to answer.
Laurance Russell with his Security being bound in a recognizance of
pounds Sterling for his the Said Laurance Russells appearance and good
beheavior appeared to answer to what Should be alleadged against him the Said
Russell.
Whereupon Proclamation was made and noe person appeared in opposition
against him and Soe hee with his Security was Cleared by Proclamation from the
above recognizance onely in Custody till till Fees Paid to the officers of this Court.
James Watts with his Security being bound in a recognizance of
pounds Sterling for his the Said James Watts appearance and Good beheavior
appeared to answer to what Should be alleadged against him the Said Watts
whereupon Proclamation was made and noe person appeared in opposition
against him and Soe hee and his Security was Cleared from the above recognizance
he remaineing in Custody till all Fees Paid to the officers of this Court.
His Majesty Plantiffe: Thomas Oate Defendant
Memorandum that the 23d day of August 1699 the Jurors for our Sovereigne
Lord the King for the body of Prince Georges County upon their Oaths did
present Thomas Oates of the Aforesaid County Labourer otherwise Called
Thomas Oates for that he the Said Thomas Oates about the 20th day of Novem-
ber in the year of our Lord 1698 att Mount Callvert Hundred within the Jurisdic-
tion of this Court with force and armes etc. One hogg of the Propper mark of
Bartholomew Goffe and the goods and Chatties of the Said Bartholomew Goffe
and of the Price of four Hundred pounds of Tobacco then and there did Steale
take and Carry away against his Majestyes Peace etc. and an Act of assembly in
that case made and Provided etc.
Joshua Cecell Clerke of the Indictments:
And now here att this day (to witt) the 26th day of September Annoque
Domini 1699: before the Justices of our Sovereigne Lord the King att Charles
Towne aforesaid came the Said Thomas Oates in Custody of the Sheriffe of
Prince Georges County and being Brought to barr in his Propper person presently
it is demanded of the Said Thomas Oates how hee would acquitt himselfe of the
Premisses above imposed against him.
And the Said Thomas Oates by John Meryton his attorney by the Speasiall
favour of this Court Soe admitted cometh and Defendeth the force and Injury
when etc. and Saith that he is in noe wise Guilty thereof and thereof for good and
Evill putts himselfe upon the Country. John Meryton.
And his Majesty allso. Joshua Cecell.
Therefore it is commanded the Sheriffe that without delay he cause to come
here twelve etc. by whome etc. to recognize etc. because as well etc. and now here
att this day (to witt) the 26th day of September Annoque Domini 1699 came as
well Joshua Cecell for his Majesty as the Said Thomas Oates by John Meryton
his Attorney aforesaid and the Jurorors thereon Impanelled being called likewise
came (to witt)
