MARCH, 1699 COURT 481
Plantiffe prayeth that the Said Defendant to his Declaration this Court may
answer according to an act of assembly in that Case made and provided.
Whereupon the Said John Cash in his propper person cometh and defendeth
the Force and Injury when etc. and Saith that hee cannot Gainsay the action of
the Said William Round nor but the four hundred and Ninty pounds of Tobacco
is Due and oweing to the Said William in manner and forme as the Said William
against him hath declared.
Therefore it is Considered that the Said William Rownd recover against the
Said John Cash four hundred and ninety pounds of Tobacco his Debt aforesaid
and his Damages by occation of deteineing the Said Debt to two hundred and
forty pounds of Tobacco of his assent by the Court here adjudged and the Said
John Cash in mercy.
Capt. John Baine Plantiff: Francis Dunington Defendant
The Plantiff by William Stone his Attorney brought his Majestyes writt of
Capias ad Sattisfactiendum against the Defendant for three hundred fifty and
Six pounds of Tobacco due by bill as by Declaration filed appeareth.
The Deffendant in his proppar person came into Court and Saith that hee can-
not Gainesay the Debt aforesaid nor but that he oweth the Said John Bayne the
Said Sume of three hundred fifty and Six pounds of Tobacco in manner and
forme aforesaid etc.
[417] Therefore it is Considered that the Said John Baine recover against the
Said Francis Dunington the Sume of three hundred fifety Six pounds of Tobacco
his Debt aforesaid and his Damages by Occation of deteineing the Said Debt to
pounds of Tobacco of their assent by the Court here adjudged and the
Said Francis Dunnington in mercy.
James Martin Plantiff: Nicholas Sporne Defendant
The Plantiffe by Joshua Cecell his attorney brought his Majesties writt against
the Defendant of a Plea that he render unto him the Full Sume of Forty pounds
of good and Lawfull money money of England which to him he oweth and from
him unjustly deteineth. etc.
Upon which the Plantiffe by his attorney afforesaid Prayeth Speaciall Baile
may be given to the action afforesaid and it is granted unto him.
Whereupon came John Browne into Court and offered himselfe to be Speaciall
baile for the Said Nicholas Sporne in the plea afforesaid according to Law.
Then did the Court adjourne till tomorrow morneing 8 of the Clock and
then mett and Satt (Viz.)
Present. Mr. Thomas Hollyday, Mr. William Barton, Mr. John Wight, Mr.
Robert Bradley, Mr. Robert Tyler, Mr. John Smith, Mr. Robert Wade, Mr.
Samuell Magruder, Comissioners.
Ordered that Isaac Williams be bound in a recognizance of twenty pounds
Sterling to appear at the next Provintial Court to Testifie the Truth of his knowl-
edge against Matthew Mackeboy in the behalfe of his Majesty.
And now here att this day to witt the 28th day of March 1699 came the Said
Isaack Williams and acknowledged himselfe to be Indebted unto our Sovereigne
Lord the King in the Sume of twenty pounds Lawfull money of England to be
Leavied of his goods and Chatties Lands and tenements respectively for his
