[416] Whereupon the Said William Gaskin in his propper person cometh and
Defendeth the Force and Injury when etc. and Saith that hee cannot gainsay the
action of the Said William Rounds, nor but the five hundred and Sixty pounds
of Tobacco is due and oweing to the Said William Rounds in manner and forme
as the Said William Round against him hath declared.
Therefore it is Considered that the Said William Rownds recover against the
Said William Gaskin five hundred and Sixty pounds of Tobacco his Debt afore-
said and his Damages by occation of deteineing the Said Debt to two Hundred
forty and four pounds of Tobacco of his assent by the Court here adjudged and
the Said William Gaskin in mercy.

The Plantives by Joshua Cecell their attorney brought his Majesties writt of
Capias against the Defendant for Eight hundred and twenty pounds of Tobacco
due upon account as by Declaration filed and account here Entred may appear.

The Plantives by Joshua Cecell their attorney haveing caused a Coppy of the
Declaration by the Sheriffe delivered to the Defendant att the time of the Serving
the writt upon the Said Defendant which was Eight dayes before this Court where-
upon the Said Plantives prayeth that the Said Defendant to their Declaration
this Court may answer according to an act of Assembly in that case made and
provided.
Whereupon the Said John Cash in his Propper person cometh and Defendeth
