Edward and Dudley Carleton plantiffe: John Gardiner Defendant: Scire facias

Whereas att a Calvert County Court held att Calvert Towne before the
Justices of our Sovereigne Lord the King the third Tuesday in March Last past
Annoque Domini 1695 [1696] the Said plantiffes by the Consideration of the
Said Court had Recovered against the Said Defendant as well a Certaine Debt
of four hundred forty Seaven pounds of tobaccoe as three hundred Sixty Eight
pounds of tobaccoe which to the Said Defendants in the Same Court were Ad-
judged for their Damages which they had by Occation of Deteyning the Said
Debt whereof he was Convicted as by the Records and process thereof here in
Court produced mor[e] Fully Appeareth And Whereupon Execution hath not
as yett thereupon Issued Forth for the Same Whereupon itt is Commanded that
the Sheriffe make knowne to the Said defendant that he be here at this Day (to
witt) the 22 Day of September Annoque Domini 1696. to Shew Cause if any he
have why Execution Should not Issue forth against him for the Said debt and
damages Recovered against him as aforesaid According to the forme of the
Recovery aforesaid and that he had then and there the Said writt and how he
Should make the Same knowne etc. And now here att this day (to witt) the 22d
day of September Annoque Domini 1696 Came the Said plantiffs by Joshua
Cecell their Attorney and Offered themselves against th[e] [48] Said De-
fendant in the plea aforesaid etc. And the Sheriffe now maketh Returne of the
Said writt that he hath made knowne unto the Said Defendant by Robert
Caleton and Josias Towgood of his being here this day to Shew Cause in forme
aforesaid etc.

And the Said Defendant being Sollemly Called in his proper person Came and
defendeth the force and Injury when etc. and Saith that hee Cannott gainsay
the Debt and Cost aforesaid but that he oweth the Same unto the Said plantiffes
in manner and forme as is before Expressed.

Therefore it is Considered thatt the Said Edward and Dudley Carleton have
Execution against the Said John Gardiner of their Debt and Damages aforesaid
together with two hundred and Eight pounds of tobaccoe for their Cost and
Charges in this behalfe Sustained etc.

Edward and Dudley Carletons against Robert Bradley Garnishe of Thomas
Bankes.

Command is given to the Sheriffe of Prince Georges County that of the goods
and Chatties of Thomas Bankes if they Shall be found in his balywick he attech
in the hand or hands of any person or persons in this County as well the Sume
of Six Shillings four pence Sterling and Eight hundred and fifty pounds of
tobaccoe a Certaine Debt for Damages upon an Attechment Recovered against
him the fourth Tuesday in August Last past as alsoe the Sume of three hundred
and thirty pounds of tobaccoe Cost of Suite in the whole amounting to the
Sume of 6s 4d Sterling and 1180 lbs. of tobacco and when he had the Same
Atteched or any part thereof the Same in his Custody to keepe Soe that he have
the Same before the Justices of Prince Georges County Court the 22d day of
September Annoque Domini 1696 and Likewise at the time of Executeing the
Said writt he give notice to all person or persons in whose hands or possesion
he Attech Such goods as aforesaid that they be and Appeare before the Justices
of Prince Georges County Court to be held att Charles Towne the 22d Day of
September 1696 to Shew Cause if any they have why the Said goods Soe Atteched
