prosecuted his Said writt Therefore hee and his Pledges of Procecuteing be in
Mercy lett the names of the Pledges be Sought etc. and the Said Tabitha Blandford
goe thereof without day it is Likewise Considered that the Said Tabitha Bland-
ford recover against the Said Hugh Fergison her damages by occation of the
Premisses to two hundred Sixty five pounds of Tobacco to the Said Tabitha
Blandford by the Discression of the Court here att her request for her Cost and
Chargees in this behalfe Susteined according to the forme of the Statute etc. by
the Court here adjudged.
William Hucheson Plantiff: Hugh Fergison Defendant
Hugh Fergison Late of Prince Georges County Chyrurgion was atteached to
answer unto William Hutcheson of a plea of Trespass upon the Case etc.
And whereupon the Said William by William Stone his Attorney Compleineth
that whereas the Said Hugh the first day of June in the year of our Lord 1698 att
Charles Towne within the Jurisdiction of this Court Stood indebted unto the
Said William in the Sume of two Thousand two hundred Ninety and four pounds
of Tobacco being soe much due to the Said William from the Said Hugh upon
the Ballance of accounts between them the Said William and Hugh as by a
Perticular account thereof here ready in Court to be produced more att large may
appear and the Said Hugh the Said William being soe indebted as aforesaid in
Consideration thereof did assume upon himselfe and to the Said William then
and there Faithfully promise that he the Said Hugh the Said Sume of 2294 pounds
of Tobacco to the Said William when he Should bee thereunto requested would
well and truly Content and Pay Nevertheless the Said Hugh his promise and
assumption aforesaid not regarding but mindeing and fraudulently intending him
the Said William in this behalfe Crafftily and Subtilly to deceive and defraud the
Said Sume of 2294 pounds of Tobacco to the Said William hath not Paid although
the Said Hugh to doe the Same by the Said William afterwards the day and place
aforesaid was often thereunto requested but hath hitherto refused and Still doth
refuse to the Damage of the Said William of 2800 lbs. of Tobacco and thereof
hee brings this Suite etc.
