Whereupon the Said Goarding by William Stone his Attorney comes and
defends the force and Injury when etc. and prayeth Lycence thereof to imparle
here untill the next Court and it is Granted unto him the Same day is given
to the Plantive Likewise.

And now here att this day (to witt) the twenty Eighth day of March Annoque
Domini 1699 came here as well the Said Nicholas Sporne as the Said Robert
Goarding by their attorneys aforesaid and the Said Nicholas Sporne prayeth
that the Said Robert Goarding to his Declaration aforesaid may answer.

Whereupon the Said Robert Goarding by his Attorney aforesaid cometh and
defendeth the force and Injury when etc. and Saith that hee did not assume in
manner and forme and of this he putts himselfe upon the Country. William

Therefore it is Commanded the Sheriffe that without delay he cause to come
here twelve etc. by whom etc. and who neither etc. to recognize etc. because as
well etc. and now here at this day that is to Say the 28th day of March here
came as well the Said Nicholas Sporne as the Said Robert Goarding by their
attorneyes aforesaid and the Jurors thereon Impanelled being Called likewise
came. (Viz.)

Joseph Browne, Charles Wallker, Archibald Edmundson, Charles Beall, John

Davis, John Dounton, William Gaskin, William Stimpson.

Who to Speake the truth concerneing the premisses being Elected tryed and
Sworne upon their oathes doe Say that the Said Defendant doth owe to the Said
Nicholas Sporne the Sume of 864 pounds of Tobacco as the Said Nicholas
Sporne above in his declaration hath declared.

[411] Therefore it is Considered that the Said Nicholas Sporne recover against
the Said Robert Goarding the Summ of Eight Hundred Sixty four pounds of
Tobacco his Debt aforesaid and his Damages by occation of deteineing the Said
Debt to Seven Hundred and tenn pounds of Tobacco of his Assent by the Court
here Adjudged and the Said Robert Goarding in Mercy.
