Therefore it is Considered that the Said Joseph Jackson and Company recover
against the Said John Chappman the Sume of two thousand two hundred
twenty and four pounds of Tobacco his Debt aforesaid and his Damages by
occation of deteineing the Said Debt to three hundred forty Eight pounds of
Tobacco of his Assent by the Court here adjudged and the Said John Chappman
in Mercy.

[410] Nicholas Sporne Plantiff: Robert Goarding Defendant

Robert Goarding Late of Prince Georges County Sayer was atteached to
answer unto Nicholas Sporne of a Plea of Trespass upon the Case etc. And
whereupon the Said Nicholas by Joshua Cecell his Attorney Compleyneth that
whereas the Said Robert at Severall dayes and times between the 7th day of
August in the year of our Lord 1698 and the 24th day of November in the year
of our Lord 1698 att Charles Towne within the Jurisdiction of this Court Stood
indebted unto the Said Nicholas in the Sume of Eight hundred Sixty four
pounds of Tobacco being for Severall Licquors and other ordinary Expences
by the Said Nicholas Sold and delivered as well to the Said Robert as to one
David Ambross upon his the Said Roberts order as by a perticular account
thereof here ready in Court to be produced may more att Large appear and the
Said Robert to the Said Nicholas in manner aforesaid being indebted in Con-
sideration thereof the Said Robert did assume upon himselfe and to the Said
Nicholas the Said 24th day of November in the year of our Lord 1698 att Charles
Towne aforesaid faithfully promise that he the Said Robert the Said Sume of
864 lbs. of Tobacco unto the Said Nicholas when hee Should be afterwards
thereunto requested would well and truely Content and pay Nevertheless the
Said Robert his promise and assumption aforesaid made little regarding but
mindeing and fraudulently intending him the Said Nicholas in this behalfe
Craftily and Subtilly to deceive and defraud the Said Sume of 864 lbs. of
Tobacco or any Part thereof to the Said Nicholas hath not paid although the
Said Robert to doe the Same by the Said Nicholas afterwards the 25th day of
November in the year of our Lord 1698 at Charles Towne aforesaid was often
thereunto requested but the Said Robert the Same to pay to the Said Nicholas
hath hitherto denyed and Still doth denye to the Damage of the Said Nicholas
of 1600 lbs. of Tobacco and thereupon he brings his Suite etc.

David Ambrose and Robert Goarding are Joyntly and Severally Debtors.
