[364] The Carleton Merchants Plantiffs: Robert Robertson Deffendant

Robert Robinson Late of Prince Georges County planter was Atteached to
answer unto Edward and Dudley Carleton Merchants of a Plea of tresspass
upon the Case etc.

And whereupon the Said Edward and Dudley by Joshua Cecell their Attorney
Compleineth that whereas the Said Robert Robenson the 26 day of September
in the year of our Lord 1696 att Charles Towne within the Jurisdiction of this
Court Stood indebted unto the Said Edward and Dudley in the Sume of four
hundred and thirty pounds of Tobacco being as well for the ballance of an
account as allso for Severall goods and Merchandizes to the Said Robert Robin-
son at his Speaiall instance and request that time Sold and Delivered by Robert
Bradley Gentleman one of the Factors of the Said Edward and Dudley as by a
perticular account thereof here in Court produced may more att Large appear
and the Said Robert Robenson in manner aforesaid being indebted In considera-
tion thereof did assume upon himselfe and to the Said Edward and Dudley
then and there Faithfully promise that he the Said Robert Robinson the Said
Sume of four hundred and Eighty lbs. of Tobacco to them the Said Edward
and Dudley when thereunto requested would well and truely Content and pay
Nevertheless the Said Robert Robinson his promise and Assumption afforesaid
not att all regarding but mindeing and fraudulently intending them the Said
Edward and Dudley in this behalfe Crafftily and Subtilly to deceive and defraud
the Said Sume of four Hundred and Eighty lbs. of Tobaco or any Part thereof
to them the Said Edward and Dudley or to any other person for their use hath
not paid allthough the Said Robert Robinson to doe the Same by Robert Bradley
Factor of the Said Edward and Dudley afterwards the Day and place aforesaid
was often thereunto Requested but the Same to Pay have denyed and Still doth
denye to the Damage of the Said Edward and Dudley of 900 lbs. of Tobacco and
thereof they bring this Suite etc.
