Executors administrators or assignes the Full and Just Sume of one thowsand
five Hundred and Sixty pounds of good Sound bright and Large Tobacco clear
from trash and Ground leaves and Caske to Conteine the Same and to be paid
att his the Said Martins then Dwelling Plantation upon demand aftar the tenth
day of November next Ensueing the date of the Said bill obligatory notwith-
standing which the aforesaid Martin in his Life time and the Said Mary whilst
She was Sole to whom administration of the Goods Chatties and Credditts of
the Said Martin aftar his Death was Committed nor the Said Hugh and Mary
Since the Espowsulls between them had and Celebrated nor any of them the
Said Sume of 1560 lbs. of Tobacco according to the tennor of the Said bill
obligatory Although often demanded by the Said Richard in his Life time or
to the aforesaid Thomas after the death of the aforesaid Richard have not
rendred but the Same to render have denyed and the aforesaid Hugh and Mary
the Same to him the Said Thomas as yett to render they denye and unjustly
deteine whereupon he Saith that he is Damnifyed and hath damage to the value
of three Thousand lbs. of Tobacco and thereupon he brings this action, And the
Said Thomas brings into Court the letters Administration etc. by which it
Sufficiently appears the Said Thomas to be administrator as afforesaid.

And the Said Hugh Reyley by John Meryton his Attorney cometh and de-
fendeth the Force and Injury when etc. and Prayeth Leave to imparle here
untill the next Court and it is Granted unto him the Same day is given to the
Plantiffe.
And now here att this Day (to witt) the 22d day of November Annoque
Domini 1698 came Thomas Greenfeild as the Said Hugh Reyley by their at-
torneyes afforesaid and the Said William Stone prayeth that the Said Hugh
Reyley to his Declaration may answer etc.
Whereupon the Said Hugh Reyley by John Meryton his Attorney cometh and
deffendeth the force and Injury when etc. and Saith that he is not informed by
the Said Hugh Reyley his Clyent of any answer for the Said Hugh Reyley in
the Plea afforesaid to be given and nothing more thereof Saith by which the
Said Thomas Greenfeild remaineth against the Said Hugh Reyley undefended
etc.
Therefore it is Considered that the Said Thomas Greenfeild Recover against
the Said Hugh Reyley as well the Sume of fifeteen hundred and Sixty pounds of
Tobacco his Debt for Damages afforesaid as allso the Sume of two hundred and
Sixteen pounds of Tobbacco for his Cost and Charges in this behalfe Susteined
to the Said Thomas Greenfeild of his assent by the Court here adjudged etc. and
the Said Hugh Reyley in Mercy.
Thomas Clarke Plantiff: James Wapple Defendant
Thomas Clarke who brought the Wright of our Sovereigne Lord the King
against James Waple of a Plea of tresspass upon the Case etc. and hath not
proscecuted his Said writt therefore he and his Pledges of Prosecuting be in
Mercy etc. Let the names of the Pledges be Sought etc. and the Said James
Wapple goe thereof without day, it is Likewise Considered that the Said James
Wapple recover against the Said Thomas Clarke his Damages by occation of the
premises to two hundred Sixty five pounds of Tobbacco to the Said James
Wapple by the Discression of the Justices here att his request for his Cost and
Charges in this behalfe Susteined according to the forme of the Statute etc. by
the Court here adjudged.
