Letters Administration of the goods and Chatties of the Said Henry Since his
decease was Legally Committed and to the Said Thomas and Jane Since the
Espowsalls between them had and Celebrated of Right to belong and pertaine
and deviseing and Fraudulently Intending Craftily and Subtilly to deceive and
Defraud the Said Henry in his Life time and the Said Jane while She was Sole
after the death of the Said Henry and the Said Thomas and Jane Since the
Espowsalls between them had and Celebrated the Same hoggs to the Said
Henry in his Life time or to the Said Jane while She was Sole after the death
of the Said Henry or to the Said Thomas and Jane or Either of them Since
the Espowalls between them had and Clelebrated Although the Said Ignatias by
her the Said Jane while She was Sole after the death of the Said Henry and by the
Said Thomas and Jane after the Espowsalls between them had and Celebrated
that is to Say the 23d day of October 1697 Att Mattapony hundred aforesaid was
often Required to doe the Same hath not delivered but those hoggs Afterwards
that is to Say the 25th day of October 1697 at Mattapony hundred aforesaid hath
Converted and disposed to his owne use to the Damage of them the Said Thomas
and Jane of 7500 lbs. of tobaccoe and in delay of the Administration of the goods
[326] And Chatties aforesaid and thereof they bring this Suite etc.
Meriton. Pledges etc. John Doe, Richard Roe.
And the Said Thomas and Jane brings into Court the Letters [of] Administra-
tion etc. that it may the plainer Appeare etc.
And the Said Ignatias Creycrof t by William Stone his Attorney Cometh and De-
fendeth the force and Injury when etc. and prayeth Lycence thereof to Imparle
here untill next Court and it is granted unto him the Same day is given to the
plantiffe Likewise etc.
And now here at this day (to witt) the twenty Eight day of June Annoque
Domini 1698 Came here as well the Said Thomas and Jane as the Said Ignatias
by their Attorneys aforesaid and the Said Thomas and Jane prayeth that the
Said Ignatias to their Decleration aforesaid may Answer etc. Whereupon the Said
Ignatias by his Attorney aforesaid Comes and defends the force and Injury when
etc. And Saith that he is not guilty of the trespass in manner and forme as the
plantiffes have Sett forth and thereupon putts himselfe upon the Country.

Therefore it is Command the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because as
well etc. And now here at this day that is to Say the Said 28th day of June 1698
here Cometh as well the Said Thomas Taney and Jane his wife as the Said Ignatias
Creycroft by their Attorneys aforesaid and the Jurors thereon Impanelled being
Called Likewise Came (Viz.)
James Stoddard, foreman, James Juers, Phillip Tattersell, John Davis, Robert
Orme, William Conley, Christopher Baynes, John Summers, Charles Hyatt,
Joseph West, Thomas James, John Deakins. Summoned per Thomas Green-
feild, Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne doe Say upon their oaths that they find for the plantiffes.
Therefore itt is Considered that the Said Thomas Taney and Jane his wife
Recover against the Said Ignatias Creycroft as well theire Damages in the premises
to three thowsand nine hundred pounds of tobaccoe by the Jurors aforesaid in
forme aforesaid Assessed As allsoe two thowsand one hundred fifty and Six pounds
of tobaccoe to the Said Thomas and Jane att their Request for their Costs and
